Labour market test for new role -- late submission

Post by lontocph » Tue May 04, 2010 12:12 am

Hello,

I'm a UK work permit holder issued in October 2006. In mid 2008 I changed role within the company (not promotion). Along with this I got a substantial salary increase and new responsibilities (although not radically different vs the old one -- both jobs are still under the same Standard Occupational Classification code). My job title remained the same.

My question: in this situation, actually does my company need to inform WP? If WP thinks the change qualified as "change of employment", is my company required to do a resident labour market test? What if the change of role happened a long time ago?

I think at the time it just slipped through the net -- I didn't know this rule, and the HR person who dealt with my WP left the company so nobody was tracking this. Please help if anyone can advise on this -- I don't want WP to think I'm here illegally. Thanks!
