"Leave Encashment"Can it be considered part of sal

Post by llcool » Wed Jun 27, 2007 10:48 pm

Hi All,

My points for the application comes out to be 70 if i do not add up my Leave encashment in the salary income. If i add the leave encashment i can score 5 extra points in the previous earning section and which will make me eligible for HSMP. Can any one suggest?

If the answer to my above question is Yes then what extra steps do i need to follow?
FYI: I have tax return acknowledgement for the period 01/04/2006 to 31/3/2007 and Form 16 from the employer for the same period but i am claiming points from 01/07/2006 to 30/06/2007 and i encashed my leaves in the current month i.e. 06/2007. I do have salary slips and bank statements for the above mentioned 12 months. But i do not have any salary slip/proof for the leave encashment. However i can have a letter written by my employer on the company letter head that my earnings from 01/07/2007 to 30/06/2007 are XXXX and this also includes the leave encashment of XXXX.

Please suggest will it be sufficient? If not please suggest what can be done.

Thanks a lot in advance. [/b]

Hi llCool,

You have raised a very interesting point where in your allowance (leave encashment) is not declared in your wage slip however, you have the same declared in the letter from your company. Also you have the same declared in your returns.

Going strictly by the guidance which states
Any allowance not declared in the pay slip should not be considered towards calculating gross pay
there is now way they can consider your leave encashment amount.

But again, since you have a letter from your employer stating the same, i guess it makes you case a bit strong.

I am however concerned that the pay slip doesn't mention about this allowance. Ideally it should.

Can any sr member advice him in this case ?

Cheers
PG
