Hi guys I need your advice on a immigration matter. I came to the UK in 1998 on a six months visa which was later upgraded to a 3 year student visa when I enrolled in University.I later got a years extension and after the year I applied for another extension and never heard from the HO. When I contacted them regarding this they told me that they did not have an application on record and I needed to get a new passport and re-apply. It took me a year to get new PP as the HO had lost my original one and sought Legal advice.

I now have a partner who has been refused asylum twice (came to the UK in 1999). We have a daughter (7yrs 8mnths) who was born here (UK) and has never left the country. My solicitor told me that I was now classed as an overstyer and he decided to submit our case to the Leagcy Case work dept in 2007. He also told us that we were unble to take advantage of the 7 years concession as this had been scrapped. We have now been waiting for over 3 years, our MP also got involved but was given the same standard reply of completion by 06/2011. I rang the HO the other day for an update and was told they arent dealing with our case yet though they requested my daughters birth certificate and photos a year ago. Our lives are in limbo and in desparate situation as we are un able to work and living like destitutes, I suffer from depression because of our situation and currently on anti-depressents. At the moment I do not have much faith in our solicitor but icant really blame him for much.
I'd gratefull for any advice

Legacy cases take a very long time and it looks like your solicitor has done all he can to help you.
You will just have to wait and the Home Office have thousands of cases to deal with and the hundreds who try and enter illegally and claim asylum every day on backs of lorries does not help your situation either

It's not your solicitor's fault - legacy cases take ages, and there's not much that can be done about that from your side.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.
