Dear Experts,

I m on WHM visa and my wife is on student visa. we r expecting a baby in May 2005. What will be the legal status of the child as we both hold Pakistani passport and will apply for one for the baby here.

We need to send the passport copies of baby to canadain high commission but i m wondering what will be his/her status. Do we need to apply to home office first and then send copies to CHC.

Can i put baby as my dependent or the baby has to be dependent of mom

any comments

Every child born in the UK needs to be registered with the Registrar of Births, Deaths and Marriages. But that will not make the child a British Citizen.

However, if either you or your wife (or both) ever get ILR then it will be possible to apply to have the child registered as a British Citizen.

Canada? Sorry, the reference to Canada is not understood. Are you all hoping to move to Canada? If so, how old will the child be when you move to Canada?

Thanks for ur reply. We have applied for immigration to canada and we will need to add the baby in the application. So when i will mail copies of pakistani passport they will definitly ask for the status of child in uk even though he/she is born in uk

is it legal for the baby to stay in uk with us without applying for dependent visa for him/her. We are not planning to go out of uk for a while and i know baby will need visa to come to uk as he/she will be non eea

Ali,

UK

1. It is not compulsory to obtain a visa for your child if he/she is not going to depart the UK but IMHO it makes good sense to do so in so far as proving both legal status and family status.

2. Obtain your child a passport from the Pakistani Consulate in London.

3. Send this passport, full birth certificate with both parents names, 2 photos of the child, both parents passports, registration docs as appropriate and the application fee using form FLR(O) to the Home Office. Alternatively go in person for same day service. Postal fee - 155, In person 250 these two increase to 335 and 500 respectively on 1 April 2005..can you get the childs ppt before then.

4. The child will get a visa with validity of either parent whichever is the longest.

CANADA

It is a requirement under the Immigration and Refugee Protection Act to update the visa office of a material change in circumstances - top of the list is a change in family composition.

Once the baby is born you must write to the visa office reqeusting the child's inclusion in your application - include/ send

1. Notarised/ certified copies of his/her ppt bio data page and that with the visa (so you have to get a passport and UK visa anyway)

2. child's photos (I believe 4 but send 8 to be on the safe side).

3. 150 Canadian Dollars - Bank draft drawn on a Canadian Bank payable to the 'Receiver General for Canada'

Quote your file number - starts with a B in all communication.

The High Commission will send you further instructions. You will likely get a request to update your family composition and funding details so start getting your bank statements ready.
