less than 1yr RC eligible for home fees?

I have lived in the uk for 3yrs but was on a student visa and currently got a rc. my spouse works full time while i work part-time. i want to strt a new course at the university and i was wondering if i would be eligible for the home fees since my main reason for living in the uk b4 i got married was for full time education...
advice or experiences would be appreciated.

If your partner is in the UK as a 'worker' I believe you are eligible under category 6 but I suggest you seek advice from UKCISA Students' Advice Line

thanks Jambo for ur reply...i have looked at the category 6 and the part i am worried about is the "ordinary resident", becos i was only leaving here for the past years mainly cos of the full time education. every university i speak to can't give a definite answer but keep quoting the category 6.

You must have been residence for three years in europe both in uk and other eu state. As for you as a student is not counted as residence so your residence started the day you got your right to residence both in uk or other eu state. For you, it will take three years before you qualify for a home student which is the requirement.. If the requirement say you must be presence or residence which is not the case, it says residence for 3yrs.
