Balance of Probability Test: The balance of probabilities test is the standard legal test applied to most decisions made under immigration law. It means that caseworkers can exercise discretion in the applicant’s favour, in order to minimise administrative burdens on applicants. This does not mean that caseworkers can grant status to those who are not eligible for it, but it does mean that, in light of all the known circumstances of the case and of the evidence available, they can grant status where they are satisfied as to the applicant’s eligibility for it. This is another reason why so many applicants are getting the status they expect.
