Let me tell you about my case first:
Nationality and family information
-Me and my wife (we are married) are not British Citizens.
-We have been living in the UK since beginning of 2006.
-We don’t have any child.
-Sticker (work permit dependent visa) in our passports is valid until March 2011.
Occupation and education– My wife
-My wife has been working in the UK but she has been made redundant.
-My wife has got a bachelors degree.
-My wife is having her executive MBA degree but she hasn’t finished it yet.
Occupation and education– Me
-I have a limited company in the UK.
-My visa is dependent on her visa.
-Most of the time I work abroad because of the nature of the business.
My questions are;
-After she has been made redundant will we be able to stay in the UK?
-After she has been made redundant will I be able to work as I do now?
I appreciate all kinds of help.
Regards...
From the info you have provided.
1. Since it is your wife who is on work permit (not HSMP), I believe her visa is invalid once the sponsor has made her redundant, and since you are her dependant your visa also end with hers. She has 28 days to either find an employer who is ready to sponsor her a new WP or leave the country. doesn't matter what the sticker (visa stamp) is upto it is not HSMP visa on which you could have stayed in the country.
2. Same applies to your work situation as your visa was given as a dependant of your wife, it means you can no longer work here.
A few choices that can come to my mind are:
1. Since you said your wife is doing Masters degree she can apply for student visa, but I am not 100% sure if she can apply within UK, You should wait for someone else's response who knows a bit more about in country applications. But remember student visas are not that easy to get. Is she studying in a reputed University or just another college? I am assuming she was doing MS to get onto TIER 1? WellShe might still be able to apply for TIER 1 if she can complete her Masters degree as they will look at the previous earnings from the time before she started her degree.
2. If you have got the desired qualifications (since you have not given any information on that) and earnings and think that you can get TIER 1 visa then you should apply for it and make your wife your dependant.
If anyone else here has any other ideas or think i am mistaken please fell free to advise.
