lisbon treaty???????????????????????????????

lisbon treaty???????????????????????????????

ok i want to know if the lisbon teraty comes in to effect as it will soon .does uk and ireland have any obligation to remove eea family permit?

UK and Ireland have an opt-out for immigration, visas and asylum so yes, maybe they can but not as an obligation, more a choice to limit immigration I'd think.

The UK opted out on Police and Judicary and the "Charter of Fundamental Rights of the European Union" , on matters which doesn't relate to EU law. They cannot opt out on immigration.The Schengen agreement is something different. That they can opt out of. On matter relating to Asylum and visa, that is the duty of the competent authority of a member state to decide. Immigration in the sense of Freedom of Movement for Union Citizens and their family member, the UK cannot opt out, as it is the mosty fundamental conerstone of the Union.

The EEA family permit has no legality for holders of resident card under directive 2004/38EC, and the UK is perfectly aware of this. For people without that Resident Card , it is fine.

I don't think much will change in that area at all, as the UK will simply ignore it or design their own interpretation, as they have done on past occasions.

The "EEA family permit" is the entry visa that is allowed by Directive 2004/38/EC.

I am not aware that the Lisbon treaty will have any impact on this.
