Hello,

I am a non eu citizen married to a french citizen. We are currently living in Spain where I have a residency card valid for 5 years . The problem is that my wife has been offered a job she really wants back in France. I am happy to move with her there but I have a project at work which I really need to complete. Since I need to remain in Spain for at least another 10 months we are considering living apart for that time. I think I already know the answer to my question, but is such a scenario possible or is my card only valid as long as my spouse is in Spain with me?

Hi,

Ask yourself the question: "Why do I have a Tarjeta det familiar Communitario"
And the answer will be your question....
is my card only valid as long as my spouse is in Spain with me?

Actually we do not know enough information to be able to answer your question...

How long have you been residing in Spain with your Eu spouse?

How often will you be seeing each other? Can the Eu spouse come back to Spain each weekend for example?

The first six months might be especially easy, but the last 4 would probably require special measures to ensure you stay within the law.

Why does one want PR, could you move together and start again? It's none of my business of course, but ask yourself that. Would PR give you access to Spanish citizenship, it might not? If you leave Spain for more than two years, you might lose PR gained.
