Long Residence ILR: am I eligible

Post by sadie35 » Thu Jan 20, 2022 7:43 pm

I came in UK on 27 April 2012 on student visa (valid until 23 March 2013)
I applied for extension on 22 March 2013 Tier 4 (i got visa but college license was revoked i was given 60 days to apply again, i applied with different college (in-time application) and got visa until 19 April 2015)
On 17 April 2015 i applied FLR(P), visa got refused on 1 Dec 2015, i applied for appeal on 11 Dec 2015 (again in-time). I had appeal hearing on 5 Jan 2017 and appeal was granted on human rights grounds with reference to article 8. (visa was valid until 18 Sep 2019)
I applied for extension on 11 September 2019 (valid until 23 April 2022)

My question is if i am eligible to apply for ILR on basis of long residence. i have never overstayed or applied late. In last 10 years i have been out of UK not more than 30 days.

any insight would be appreciated.
Thankyou in advance.

@zimba hi again I wanted to double check with you. I cam in uk on 27 April 2012 and my current leave is expiring on 23 April 2022. I went to see solicitor and he advised to apply on 21 April 2022 and do biometrics after 27 April 2022 as otherwise I will not complete 10 years. I wanted to ask about 28 day rule can I not apply 28 days before I complete my lawfull 10 years.
Thankyou in Advance

Check p14 of this UKVI document https://assets.publishing.service.gov.u ... gov-uk.pdf

Slap it on the face of your solicitor and ask for a refund. :D

There is no such a thing as the 28 days rule. It is simply a concession provided by the home office for all ILR applications where you can get ILR before completing the qualifying period for ILR. UKVI will use the date that is most beneficial to the applicant, so the date of decision is used.

You definitely can! You obviously know more than your solicitor.
