Post by actionman » Tue Jul 08, 2008 12:20 am

Hi

can anyone help me

I’m Student and I have been in the UK for 11 years as student and I applied for indefinite leave to remain in UK on 07/2007 and got refused because a gap of 23 days on 2004. All the past Leave To Remain as student I had them from the airport and at airport the officer refused to extend my visa, because they don’t give it anymore in the airports which I didn’t know and I had only 1 day remaining which is Saturday but the officer refused to extend. I applied for the visa and got it. I am married and have baby both are with me in the UK. So please if you can help me.

As you had 1 day remaining, did the Immigration Officer permit you to enter? Did you apply by post on Saturday before the expiry of your leave to enter/remain? Did you keep proof of posting? If you had posted your application in-time, then your leave would have been treated as continuing and there would be no gap. Also suggest that you make a subject access request.
