Hi,

I am leaving for UK on tier1 visa and being send by my India based employer. Since my dependent has no UK visa currently, Ideally I will have to file tier1 dependent visa for them but is there any possibility if I can get visitor visa for them ?. As my own visa ( tier1) will expire in August 2012 or my company file Visitor visa for my dependent by giving in writing that this is genuine case.

Incase I don't get visitor visa and I wish to apply for tier1 dependent visa for them then how much maintenance i need to show in my indian bank account, considering I am already in UK for last 2 months and my wife and child is in india.

Any immediate reply shall be highly appreciated.

When applying for a visitor visa, you have to prove that you have very good reason to return to your home country. As you are saying that you are not sure whether you want to apply for a visit visa or dependent visa, it is clear that your dependent doesn't have good ties to go back home (and the fact that you will be in the UK), so it will be almost impossible to get a visit visa.

For dependents maintenance, you have to show £1600 in addition to the funds you used for your own maintenance (e.g. you cannot re-use the same funds for dependent maintenance that you used for yourself).

Thanks for update,Will they be convinced that I will be back once my work is over there, even if my company gives in writing that i will be back and I have no plan to stay there permanently ?.

Can you please tell me the exact amount in GBP which I need to maintain before applying for dependent tier1 visa. is it this 1600( Self) + 3200 ( for two dependent) or more ?... I shall be thankful if someone could let me know the exact amout where main applicant is in UK and 2 dependents are in India.

Second question, If I apply the visitor visa now when I am already present in india ? will there be problem or any chance of getting that visa.

Usually people apply Dependant visa first. And if does not work they apply Visitor visa.
How do you convince the Visa officer that your wife will return to India after that time? Is she working/ studying? You need to show proper evidence for that.
Do not plan to submit dependant visa immediately after Visitor visa rejected. Your chances will be less.

For dependant visa, the fee is INR 60K. Funds you have to show £2800 for main applicant and £1600 for dependant if main applicant is outside UK or for less than 12months in UK. (Usually in Guidance you will find £800 for main application. But our dependant visa got refused for this reason, ofcourse I appealed on it).
