Hi.. I am back in the forum after long time with new question.

I will cut the whole story and tell main points.

We ( Myself, sis, bro and parents ) received ILR in Nov 08 after being on Asylum.

My sister got married in Feb 09 in Pakistan and has been living there since.

She came to UK in July 09 and lived for a month and went back.

She is now back in UK and planning to go after a few weeks.

Now the question is!! What does the law say about being away from UK if she wanted to apply for british citizenship>? We fear that HO may revoke her ILR if she kept on living in Pakistan for that long or permanent.

Can someone explain this situation please?

I'm pretty sure that if she's away for longer than 2 years, her ILR will be revoked (as the rules are now).

So what's the best thing for her? Her husband does not wish to settle in UK and she can not live without him.

She does not want to lose ILR either.. Where does she stand now?

1st time she went in Feb 09 and came to UK in July 09 ( After 6 months ).

Went back to Pak in Aug 09 and came in Jan 10. ( Approx 6 months )

And planning to go again by the mid of Feb 10.

Ok based on that she still has her ILR but if she makes Pakistan her home and does not naturalise as a british citizen then she will lose her ILR. So she has to make the decision of where she wants to live.

When you say 2 years, what exactly does it mean?

2 years in total on ILR or 2 years continious on ILR.

Since she has spent 10 months outside of UK in 1 years, when would she become eligible to apply for natnaturalisation?

Hello

What I don t understand is : why does t she apply for Asylum and spend half of the time in her home country ??

I tought that one asks for asylum when one can not live in the home country. I m confused

I m sure she has a house in the UK and get benefit

If her husband can t live in the uk ,fair enough, why does she need the british citizenship ?
