Marriage to non-eu with PR

Getting confused with definitions here I think.

Party 1 is a non-EU national with Permanent Residency in the UK

Party 2 is dual british and irish citizen

Do they need a Certificate of Approval for to marriage in the UK?

If the non-EU citizen has settled status (e.g. - ILR or PR), then there is no need of CoA from UKBA for the two to marry in the UK.

Its a pity the people who handle these things could be so certain. Croydon Registry office say they aren't sure and want to see the "Perminent Residency letter" before confirming.

UKBA also say not sure as rights were retained (and confirmed as retained) but will check with the "Policy Team"
