i came to uk in 1998 and in 2001 my asylum case refused. due to my circumstances i married in church eventhough my wife is british and have 1year old doughter i am not sure now how i can get application for marriage certificate can any please help me?

I don't understand. You got married in Church. Surely you have a marriage certificate.

Where did you get married, in the UK or somewhere else? If in the UK, you should have registered before getting married and submit certificate to the register office in your county so it will be recorded and you will be given a copy.

yes i have a marriage certificate but it is from orthodox church in uk

It's not really clear whether you are enquiring about making an application to UKBA for leave to remain on the grounds of your marriage, or for a Certificate of Approval to get married. If the latter, it would be a strange application if you are already married.

I'm not quite clear how it works with orthodox churches. People can get married without a C of A in a Church of England, and on a Greek Orthodox website I've just looked at it says that most of their churches are approved for marriage ceremonies. but the instructions start with a requirement to get a marriage licence from a registry office. So did you get one? Perhaps you should ask the priest who married you whether the marriage has been properly registered. If it has, you can go ahead and apply for LTR.

If you married in any church other than a Church of England without a Certificate of Approval from the Home Office, then the marriage won't be recognised for Immigration purposes, even if the church was licensed for marriages.
In addition the marriage doesn't give the legal right to remain in the UK.
I'm confused too with what you're actually applying for.

When did you get married? Also as already mentioned am not sure you can apply for certificate of approval if you are already married.

the reason i am asking you how to get certificate of approval because i want to re-marry in civil ceremony to make it more credible in order to be accepted by HO.

Then apply to the UKBA for a COA for marriage by filling in the appropriate form, which you can find on the UKBA website. If you get it, you may then marry at the registry and obtain a green style marriage certificate.
But please be aware that your applying for a COA from Home Office may alert them to your illegal presence in the UK, and you run the risk of being removed.
The marriage alone, if you manage it, will not make you legal in the UK.
Can you not go back to your home country, marry there, and then apply for a spouse visa to return to the UK? It's much safer, albeit more expensive. But really the best option.

for your information i leave in this country legally even permitted to work but i have to report to immigration officer monthly. and i cant go to the country i came from due to real danger from war. but the only option i can have is if HO allow me to go any neighbour countries start the process from there.

I'm sorry. I assumed you were illegal because you said in your initial post that your asylum case was refused, and you didn't elaborate.

If you are on reporting restrictions, you almost certainly do not have any "Leave to Remain", you only have Temporary Admission granted on form IS96. You only have permission to work because at the time you applied, permission was granted if you didn't get an initial decision within 6 months.
If you leave the country, any application that you have made will be treated as abandoned, and your case will be closed as a Failed Asylum Seeker who has departed.

would it affect me if i leave this country and re process family re union with my greek Orthodox Church marriage certificate in uk.

I'm not sure, but I suspect your marriage would be disregarded because it's not legally registered here, and that is the requirement. There are countries where a religious ceremony can take place but it is not recognised for legal purposes unless it is registered with the civil authorities, and I don't think they'd recognise yours in the UK unless it has been recorded by a Registry Office.

In any case, where are you thinking of going? You say you can't go back to your own country, so which country would accept you? How would you get a visa? Have you got a passport? If you have, why haven't you surrendered it to UKBA?
