My partner has already married in the Uk. He is an illegal immigrant. He is awaiting divorce. I am pregnant and we are planning to go to Nigeria to get married. I am worried that we may habe troule returning to the Uk. Obviously I want us to stay together as a family. Any advice would be appreciated.

First of all your partner needs to leave the country voluntarily before he is found to be an illegal and then deported as that will have major implication on his future application.

Secondly he can not marry you till his Decree Absoloute is finalized.

Thirdly he will need to apply from Nigera for a spouse visa and that will mean seperation for some period ranging from from a weeks possibly to 10 yrs if teh ECO deems that your husband in some way frustrated teh authorities to try and remain in teh Uk one way or the other.(however this is rare but it does happen).

In order to be sucesful with your hubbys application both of you will need to meet the essential criterias to qualify for a spouse visa.
This will mean that you have to show you can support ,maintain and accommodate him without recourse to public funds.

If you can do all above, tehn you stand a good chance of your hubby getting teh visa, otherwise you may be struggling.
