Marriage Visitor Visa (with a previous visit visa refusal)

Dear All,

I am at a loss here- what sort of proof should we provide to show that my fiance (who will be visiting me on a marriage visitor visa next year) intends to return home after completion of our wedding here in the UK? He is a national of another country and working in a different country. Rents a flat, has a car, but what else can we include?

I can easily apply for a fiance/spouse visa as we meet the requirements and I have met him in person, however, we genuinely do not intend to reside in the UK in the near future and therefore do not see the point of us using the fiance/spouse visa route.

'Rents a flat and owns a car' won't be considered at strong ties to his home country. i.e nothing much to lose if he didn't return. The Entry Clearance Officer will want to see evidence such as property ownership, permanent employment or long term study, family dependants etc.

Have you met in person yet? If not, a Marriage Visit visa stands no chance of being granted.

That's what misled me. I assume then, that they met sometime, somewhere other than the UK between May and now.

Unfortunately the UK immigration system is not configured to promote relationships formed at a long-distance.
There is no concept of a dating type of visa available in the system.

If there was a plan to settle, at least for a medium term, other routes into UK are via conventional work or study visas.

If settling in UK is not on the cards then the other option you clearly have is to marry abroad.

Well a marriage visitor visa would be applicable if there was no intention to settle in the UK after the wedding. However, this wouldn't give any concession for the husband to have right to entry into the UK in the future as the spouse of a BC.

Sorry I kind of rushed my initial post. Yes we ended up meeting, I went to see him for a week sometime back and he had got his family to come round to visit me as well. It was really nice!

Our issue is that he has ties to his country of birth, he has property, is only child of parents and needs to be closer to them (I guess living 2 hours away is better than 9 hours away by plane?). He is, however, working in another country (than his country of birth) at present, which is our issue as I doubt there is much else we can use to show he has ties in the country he is working in.

In which case, what are we supposed to do? I don't mind going directly for the Fiance/spouse visa route as I am earning sufficiently and have savings etc, we have booked (provisional just yet!) a venue/invitation cards/catering/photography for our (religious) wedding we expect in April. I have contacted the registrar's office as well but no reply from them yet but I'd like to have the legal wedding at the same time as the religious ceremony.

However, we genuinely are not planning on staying in the UK for the next couple of years at least, so I see it as a waste of money to spend all that on the visa and not even making use of it.

Alternatively, we could consider getting married in another country but I genuinely do not want that as my parents will be unable to attend the wedding (basically my mum cares for 2 of our family members who cannot travel, incl. my dad and I'd really want them all to see me married!)

I have seen a lot of people in our community get married this way, who have been in a similar situation too, (the marriage visitor visa route), so I am sure there must be a way out for us? It's just they are so unwilling to offer advice!

We were also thinking maybe of consulting an immigration solicitor for this. There are firms out there saying they can do the application for us on a no win no fee basis- in a bit of a dilemma here!!! (ok I am actually terrified a bit)

What do you all suggest? I really do appreciate all your help!!!!! Please tell me if I have overlooked/missed anything else which I need to take into consideration for the application as well...
