Married abroad after tier-1 approval.

Post by london82er » Mon Oct 05, 2009 10:32 am

Hello

I was granted tier 1 in May 2009, switching from a work permit granted in August 2005, making me (I think) elligible for ILR in August 2010.

I got married abroad this August (2009) to a non-UK national. My wife is not yet joining me in the UK because she is finishing an experience in the US. We intend for her to move over here in May 2010. I did not list her as my dependent in May when I applied for ILR because I believe she's not technically my dependent (in the UK or even abroad as she is on her own salary) and because she's not intending to move over here right now.

I'm planning to use an expert to handle this but would be helpful if someone could enlighten me on the following questions I have

- first of all, should I have noted her as dependent in my application (made 3 months before our marriage)? Should I update the Home Office now (I understand they should be notified of a change in circumstances?)
- what's the best way for her to come over? Should she apply as dependent on my tier-1? When should she apply? My understanding was that if she applied now and was successful she'd pretty much have to move over now?. If successful would she be able to work and would she be able to switch to ILR when I do?
-Is there any benefit for her to wait until I get ILR and then apply?
- should she better come under a fiance visa (only available when I get ILR) and we would then marry again in the UK?

Many thanks in advance for your help
