marrying a us citizen in the us

Post by mikeouk » Thu Oct 09, 2008 9:53 am

some of you may have read my previous post regarding the refusal of entry to the uk of my american girlfriend. She was granted entry to the uk in the middle of july and was due to leave on the 5th january, this was just as a visitor, we decided to go for a holiday to turkey and when we arrived in the uk on sunday morning, she was held for 6 and a half hours and refused entry due to border control not being satisfied she wasnt intending to settle, she was given 3 days leave and flew back to the us yesterday. So,,,its left us trying to decide on our next step, obviously she is going to have problems entering the uk now as a visitor, so before she left we discussed if it was time to move our relationship on. So an option we came up with was for me to go to america and get married there, our intention wouldnt be for me to settle there but for her to come here, we just thought it may be easier that way because it will eliminte the need for her to have a uk fiance visa and just apply for a spouse visa. My question is, what kind of visa (if any) do i need to get married in the us if im intending to return to the uk shortly after the wedding.
I realise this isnt exactly a uk immigration question but im hoping someone here will be able to give me the info i need.
thanks

This has been asked many times in the US Immigration section.

If you are not intendind to return to the UK after marriage, you may enter the US on VWP. I also no this from experience because my Brother-in-law is British and came to the US on VWP when he married my sister. No problems there. You just need to make sure you have all the correct documents ahead of time for applying for a spousal visa. I don't know what went wrong, but my sister had to return to the US after about 3 months in the UK to get her spousal visa. I believe they were misinformed on the process that caused this, so be sure to research that part thouroughly.

Best of luck!
