Hi,

My friend is disabled (as a result of an accident) and receives DLA and Incapacity Benefit. Her parents have arranged a guy for her to marry, however he is an illegal immigrant. My friend and the guy liked each other after the parents introduction, and they have been dating. The guy has proposed marriage, and my friend has accepted.

As my friend is disabled and does not cope with stress well, she has asked me to find out about the practicalities of getting married to the guy. My friend is conscious about her biological clock and wants marriage and children as soon as she can.

1) Can she marry her illegal fiancé legally?
2) How would they go about getting married officially?
3) Would my friend's disability affect anything?
4) Would my friend's benefits affect anything?
5) Does the fact the guy works affect anything?
6) Would the guy have to go back to his home country in this process? It would be hard for my friend to bring him over because if her disability.
7) Anything else we should know?

Yes she can, whether the Registrar will allow it is up to them. They usually like to see the Passport. Speak to the Superintendent Registrar. Once married the spouse can apply for spouse leave from outside the UK - a 5 years route to settlement and because your 'friend' is receiving DLA, they will be exempt from the Financial Requirement, they will only have to show adequate maintenance and accommodation. A1 English will be required for spouse leave.

They may also consider applying from inside the UK, under FLR(FP) and exception 1(click) - a 10 year route to settlement. However, spouse leave would be most wise. The 'guy' shouldn't be working if he has no right to.
