Meaning of Continuous Stay in Indefinite Leave to Remain

Post by Akoba » Tue Sep 07, 2021 10:18 am

Hi All,

Do I qualify for Indefinite Leave to Remain if I stay on Tier 2 visa for 3 years which was not renewed by my first employer, but leave the UK and return back in less than three months on another Tier 2 visa for two years for my second employer ? I did not overstay. Do I qualify under the continuous stay requirement?

You will not have broken continuous residence if your permission was valid when you left the UK and applied for entry clearance within 14 days of that permission expiring and the application for entry clearance was successful.
