Re: Spouse visa appeal (article 8 human rights)

I can see why having mental health assessed can scare you. Maybe just general points can be discussed with the GP, and go through counseling they will offer. A record of stress, anxiety or depression with GP. Not having a relationship with biological father doesn’t give you advantage (I think). I mi...

Re: Spouse visa appeal (article 8 human rights)

Your wife can submit a medical reason why she can’t work full time - mental health related (please be genuine) A letter from school that highlights negative impact on the kids to move abroad, if possible. A private agency can also be hired to observe kids and write letters for immigration. Expensive...

Re: Waiting on Appeal to be heard after home office refusal of spouse vissa

Two weeks I think. From my personal experience they didn’t bother to write to me or the lawyer. They did however send the letter to HO. Lawyer kept contacting court and found out the decision was made (14 days) and then he had to chase them up for decision making outcome. Give it few more days then ...

Re: Spouse visa appeal (article 8 human rights)

Hi We provided evidence of job applications, and they agreed that he is skilled to work in the UK. This wasn’t again covered in judges refusal but discussed in the hearing. Besides, no one really wants to hire anyone from non EU counties. So it’s pointless to show a employment letter, as we can all ...

Also, lawyers and barristers are paid to be positive. Don’t depend on what they think the chances are .... it’s all business to everyone.

Specially the senior ones.

Re: Spouse visa appeal (article 8 human rights)

Hello I am in appeal process (since July 2019) My appeal hearing was in March 2020 and was refused. Now the judge I had was a former Home Office representative, which is what led to refusal we all think. Home office said in the appeal that they will accept the third party support as long as I can pr...

Re: Spouse visa appeal

Yes. It’s dismissed - still not satisfied that I have exceptional circumstances. The judge is new and he worked for home office as the representing officer so he’s got the same home office mentality, which is apparent in the letter. Did not look at evidence provided or asked me certain questions on ...

Re: Spouse visa appeal

Hi,

My hearing was 26 Feb and the home office rep did attend and that’s when they brought their bundle - which I never saw but barrister did just before the hearing.

I’m waiting for outcome.

How’s your situation?

Re: Appeal submitted - no bundle provided by home office

I had my appeal hearing on 26 Feb. The bundle was never provided prior. Home office brought it on the day. We had video link. Home office representative had asked for this so applicant can provide their evidence. The HO rep on day didn’t see the point of this, nor did my lawyer and barrister and eve...

Re: Meeting income requirements - zero hours contract

Hi, Look for jobs at councils as they offer better hours and pay. Even on zero hours they usually allocate certain teaching hours a year for their budget too. This can be written on a letter from employer when submitting your application. But it comes with uncertainty. The jobs at colleges are adver...

I have not had my hearing yet - will update when I do.
They intend to come as they have said they will in a letter of correspondence between my solicitor and court.

Re: Appeal submitted - no bundle provided by home office

Hi fififadi, Yes, I have my appeal hearing in approx 2 weeks time. The home office requested witness statements and have also requested for the video link which we had put forward. This means, they want to speak to my spouse in court in addition to me, separately. We need to make sure our points and...

Re: Spouse visa appeal

After the 15 weeks are up, I’d say it can take a few weeks. Usually the court hearing date is given in that letter.

I personally got mine within 2 weeks of 15 period week being completed.

Re: Spouse visa appeal

It’s normal for Home Office to not provide a bundle, as they can provide it even a day before the hearing. Also, reverse decision very close to court hearing date.

When your 15 weeks are up, court will send you letter for court hearing date. Regardless if bundle is provided or not.

Na, the social services are not giving us permission for going anywhere together.
Not sure what to do?
That would make obtaining a visit visa out of the question, no? As you would be together..

Re: Apply for my husband to come and visit our British child

I agree.

If your husband can save £40,000GBP in Bangladesh, that’s pretty impressive. Stay there till you saved up enough.

Is it indeed a lot of money that has gone to lawyers who give false hope. The business is booming from people like ourselves.

Re: Apply for my husband to come and visit our British child

Also, I applied for Ireland visa over 2 years ago. They were suppose to process visa within like 8 weeks. I got letter via post requesting documents a year later, and even after submitting documents it got refused stating no response was provided. That’s probably because there’s a massive backlog fo...

You sound like me, three years ago. And here I am still without my spouse. Visit visa was rejected for the reason explained - having stronger ties in UK. I have my appeal soon as my application was refused so will update the outcome regarding article 8. I do not meet income threshold. As they get ol...
