Re: French Visa application for long-time resident of UK (Indian national)

- if not, does anyone know how quickly one can obtain a BRP? I know online it says up to 6 months, but given our trip is in July (and my mum has been in the UK for so long), I am hoping it will be a lot quicker so that I can then make the visa application! I don't want to go into the why she didn't...

Re: ILR dependants few days short of 5 years.

You risk a refusal for the child failing to meet the English requirement. It is as simple as that. Your choice if you want to risk it for the sake of a £150 test that takes 10 minutes.

People on the forum haven't used GCSE from school, they do the B1 test.

Re: ILR dependants few days short of 5 years.

It doesn't explicitly state that it applies to dependents of your visa route though. Skilled Worker dependents have always needed to meet the B1 English test. It applies only to applications under Appendix Student, Appendix Skilled Worker, Appendix Representative of an Overseas Business, Appendix T2...

Re: Spouse visa to ILR absence

You have not stated what date she entered the UK on a spouse visa. The date of entry to the UK is the start of the 5 year qualifying period. She can apply within 28 days before the 5th anniversary of the date she entered the UK.

You were already advised in December 2023 that your qualifying period starts with the initial visa approval/start date!

1. No evidence is needed.
2. Neither. It is the first visa approval date

Re: ILR dependants few days short of 5 years.

I see thanks for your clarification if one of my dependents turned 18 but had passed LIUK, and had GCSE at grade I think 8 in English from school is that enough as proof of English language or does she need to do a B1 on top of that GCSE is not enough. Anyone over the age of 18 must do the B1 SELT ...

Re: ILR dpendent 18+ child

My son was a war during application. What?? Cost wise there is no dfference since he is 18+ he will pay normal fee.. The fee for ILR is the same for everyone, regardless of age. If he was under 18, it would still be the same fee as an adult. Also I will use most of the documents for my son. Is it a...

Why didn't you apply for your son when your spouse applied? That would have been the simplest way to do it.

Re: Financial Year Cut-off Date & Items on the Checklist for the ILR application

I have completed the 1st 2.5 years, the next step is to apply for ILR
If you have only completed 1 x 2.5 year spouse visa time, then you do not qualify for ILR (indefinite leave to remain). You need to be applying for a second 2.5 year FLR(M) visa extension, which is different to ILR.

Every BRP you applied for, whether a BRP renewal, a visa extension or replacing a lost BRP, will each have their own new identifying number.

Re: Clarification on information in email received to apply for evisa

2. Do you mean and can confirm that a renwed BRP (for those with ILR) has a different number from the one in the initial BRP that was valid for 10 years?
Each BRP issued has its own unique number. It is not the same number for the whole immigration journey.

Re: Spouse Dependent Visa Queries

Spouse Settlement visa has more stringent requirements. She would need English A1 test, you need to prove you meet the financial requirements for a minimum of 6 months. You have to prove you have adequate accommodation. It will be 2 x 2.5 year visas. It is more expensive visa fee. Has no restriction...

Re: Can we apply for Schengen visa while on a UK tourist visa?

Or do they have to get their Schengen visa from India before travelling to the UK.
They need to apply in India before travelling. As part of the Schengen visa process within the UK, they have to prove they have residence in the UK (BRP card for example), which they don't have.

It is their visa category that determines the form they apply on, regardless of what doesn't feel right. You need to complete the form as best you can. Their ILR is based on your previous visa category and you now holding ILR.

You applied using the wrong form!

They apply on form SET(O). You need to submit a new application, and will have to pay fees again. The other fees will be refunded.
