I don't think it's senseless at all to speculate. The EU Directive is quite clear in this respect about what rights EU nationals and their family members obtain. It is either the UK govt abides by it or risks a court case. We'll see about that soon. Once again, I meant the non-EU angle. Whatever re...

I wonder if this would not be an infringement of EU law that provides EU/EEA citizens and their family members the right to permanent residency in any member state where they have resided in line with the regulations for 5 continuous years. Taken from the EU Directive/2004/38/EC: I only meant chang...

It would have to be explained in writing, but we can guess that "probationary citizenship" will probably replace PR / ILR and will effectively fall under the same rules, similar to HSMP being replaced by Tier 1 (General)...

100% difference in processing times for Tier 1 apps

It starts coming to light that recent Tier 1 applications, including those under the HSMP Judicial Review have significant difference in processing times: a noticeable percentage is decided within 10-12 days (i.e., about 2 weeks), another sizeable chunk is processed in 23-25 days (i.e., almost 4 wee...

So what happens if we declare our marriage before she applied for a visa extension, what affects would it have on my case and on her? What do u suggest?? I don't think you can "declare" it, as it probably isn't valid in the UK for legal reasons - that's what "not recognised" means. Marriage cannot ...

I hope any subsequent application she makes for a student visa will be judged on its own merits, with no reference to your situation. Should you come into the spotlight, it certainly wouldn't help, as raises doubts regarding her real motives, despite her studying record...

This will not affect either of your cases, because neither of you has the right to stay in the UK (once her visa expires).

Re: ILR counting time

Dear friends, I am a bit confused about the 5 years counting time, and I would be much appreciate if any of you can help me. My husband was granted a work permit visa on 18 Nov 2003 while he was in the UK (Prior to a work permit visa, he was on a student visa). However, he started his job on 12 Jan...

A candidate question for FAQ?

Having gone through the FAQs in this question, I note that the questions of spouses with insufficient qualifying period is not covered for ILR, nor for naturalisation applications. I.e., in a scenario where the dependant spouse of a qualified applicant has joined him / her in the middle of the quali...

Having lived in a similar metropolis - New York City - for a number of years, I find London a very friendly place in comparison. Yet, if you were coming from a socially warm Mediterranean village, you might find London (or many similar cities) a non-caring busy ant-house, where you shouldn't be gett...

In a way, the question is almost wrong... There is hardly a clear set of "comapnies that sponsor" versus "comapnies that don't". Many companies are technically capable of sponsoring WP candidates, but are *unwiling* to do so because they have plenty of eligible candidates. At the same time, there ar...

Cosmopol, that is a chilling prospect. As no-one except prospective candidates for naturalisation would be enrolled in such programmes, this would be a humiliating shambles for the participants and would achieve the opposite of integration. the involvement of most British subjects, or indeed citize...

I thnk, in theory, if the government REALLY want to i) help the charities, and/or ii) immerse future citizens into the "fabric" of British life as it is understood by the Ministers - and if they really put their mind to it, then technically it can be done. Charities and other organisations in need o...

My wife an I both work in respectable jobs. We have been together as a couple for nine years and married for three years. I would certainly agree with the above. If she is applying for a student visa, she either has a case for it (i.e., all the necesary admission papers from an approved institution) or doesn't. In either case having mentioned a boyfriend or a relative or a bunch of friends will not help, but might simp...
