Re: what if somebody is director but not on company payroll

For visa purposes to satisfy employment requirement, a job created has to be a new job. So positions that existed before you joined the business will not be acceptable. Secondly an employee must be on payroll (can be a director or an office assistant). Thirdly, an employee must be British or a settl...

Re: Staring for Tier 1 Enterpreneur

Hello, Do check the link with eligibility, but it is most likely you will need to go via the £200,000 route. Regarding the business, you need to ensure that you can demonstrate that you (or your wife if she is the main applicant) have experience and skills in running the business you propose to unde...

Hi Puneet, Could you please clarify which visa you are thinking of applying? Tier 1 Investor has £2mil investment requirement, Tier 1 Entrepreneur - £200.000. From what you wrote it looks like you are thinking of Tier 1 Entrepreneur in which case you can get funds from third parities e.g relatives o...

Re: Do I need a Solicitor?

It is not mandatory to have a solicitor, but my advice is do get one. A good solicitor is priceless. Entrepreneur visa is a complex application and unless you are a practicing immigration solicitor yourself you wouldn't know all the nuances and details. Besides having a solicitor gives additional co...

Hello, 1) For investment funds, you can apply now, however if you hadn't held your funds for consecutive 90 days you would need to supply the document confirming the source of fund. Re: What if £200,000 have not been spent?

In your case I would suggest investing the remaining funds in another existing business. This way you will comply with the visa requirements and will have already a team in place that would run the business, so you will not need to worry about diverting much of your attention from the first business...

If you invest money in your UK company which spends the money purchasing goods abroad which, for example, you then sell in the UK this is fine as long as you have valid contracts and what you do looks sensible.

Third party funding is fine as long as it is equity funding (ie funds from an investor).
Debt funding, such as the bank loan, will be questioned and whether or not it will be accepted will depend on your overall business proposal and business model.

The words "money must remain available to the applicant until such time as it is spent for the purposes of his business" were in the rules at the time you received your visa. They didn't make any changes, they just clarified what is meant by " spent ". In my view this applies to everyone who obtain...

Re: Director's salary and investment

It is one of the cases where UKBA has been rather clear in their guidance. As it stands at the moment "spent" for the purpose of your business excludes remuneration of the applicant. As there is no other rule to the contrary it will certainly apply for the extension applicants. I don't see why ther...

If you buy a business where 100% of the money goes to a previous owner, this will not be acceptable. It doesn't matter what type of business you buy whether hotel or something else. From my understanding this is exactly what you proposed to do in your business plan. If this is the case, UKBA decisio...
