EEA residence permit refusal - urgent advice needed

Hi All, Just received a refusal for my wife's EEA residence permit. Refused on centre of life. We were in France for just under 6 months, but my wife became pregnant so we had to come back a little earlier than planned. Baby was born in March 2017 and is British. We have the 14 days to appeal, I'm i...

Re: EEA2 SS application documents for 2017

Stage 3 and 4 is mostly not compatible with EU law and I'd happily fight this on appeal. I'm actually still technically working in France doing some consultancy and paying taxes etc. Had the clients so might as well keep it up. ... Suggest be careful about that if you now have to show you are a qua...

Re: EEA2 SS application documents for 2017

The new regulation governing the SS route (Regulation 9) came into effect on 25th November last year. And it explicitly provided that all applications made, but not decided on the 25th November, would be decided based on the new Regulation . You may use the old forms before 1st Feb if you wish, but...

Re: EEA2 SS application documents for 2017

As the latest guidance doesn't request proof the British citizen to be qualified person you don't have to include it, but serval people have posted about their applications submitted many months before the changes but not decided yet, have been requested to supply further information. The new regul...

Re: EEA2 SS application documents for 2017

Thanks for taking the time to reply. That reinforces my thoughts, that despite them saying it's not required, better to send it as backup just in case. It's all still in the file that was returned from the FP application so isn't arduous to collate. Some of the documents are in French (residence con...

EEA2 SS application documents for 2017

Hi All, We are: British citizen + non-EEA, married in the UK 2015. Lived in France for most of 2016. Returned to UK late 2016 with a Family Permit. I am now applying for my wife's UK residence card, using Colin Yeo's guidance of filling in the older EEA2 form instead of the most recent EEA FP one. A...

Re: SS route France Brit/Chinese Family Permit Success stori

Sorry, you've lost me on 'having a sponsor'? I was under the impression that if a FP is granted, it's basically an admission of acceptance that you have exercised your treaty rights (which is basically what we need to prove for SS). I mean the non-EEA applicant for RC has to show they have a sponso...

Re: SS route France Brit/Chinese Family Permit Success stori

Family permit granted Wednesday and finally received today. I would have preferred to include a few extra documents, but it seems that was enough. Which means my wife can make it to the USA to help her sister with her new baby (the first!) and still come back to Britain without visa/entry hassle. We...

Re: Enter UK with Article 10 - Should I email Immigration fi

Me three! I've read a couple of stories of people doing this successfully (sometimes with a mild rebuke from the IO), and a couple of stories of refusals. I'd be interested to hear any success stories from people that have actually done it, and through which channel (Dover-Calais, flying, which airl...

Re: SS route France Brit/Chinese Family Permit Success stori

I'm a chinese and have lived in France for long enough to know their bureaucracy, so I've decided to moved to the UK just to find out that HO is no less of their counterparty in France. Anyway, the bottom line is that if your wife can prove that she's a family member of you, a EEA national, at the ...

Re: SS route France Brit/Chinese Family Permit Success stori

What's border control like between Ireland and Britain? I've heard of people travelling between the two with no checks at all, but that seems unlikely?

Is it really that easy? Flight or ferry any different?

Re: SS route France Brit/Chinese Family Permit Success stori

Definitely, How ever I would suggest keep simple! True! But it's in English already so no translation needed. If refused we're trying to decide whether to go direct by overland route and fight at the border, or just re-apply. In terms of travel, there isn't much in it. We're right down south, so a ...

Looking through paperwork here, I've just found a letter from my UK local council confirming my status as being registered to vote abroad. Help for 'centre of life' proof?

Re: SS route France Brit/Chinese Family Permit Success stori

So here's an interesting one. A bit (OK, a lot) of reading recently, and it turns out there's a very, very little niblet of information that says you can actually exercise your treaty rights from within the UK, if you have a business/self employed with a large market in Europe. On the basis that yo...

Re: Additional Supporting Documents for EEA Family permit!

Much the same in France, it seems to have gotten a bit slower in July which I'm sure is due to lots of staff on holiday. I would think it's almost impossible to change or add any extra documentation though. From experience of dealing with visa applications in the UK, they simply don't listen to anyt...

Re: SS route France Brit/Chinese Family Permit Success stori

One word of caution. It's not advisable to quote the 'centre of life' rules to the IO on entry into the UK. The Home Office have been known to refuse applications based on Surinder Singh due to the applicant having the prior intention to 'circumvent the Immigration Rules '. :| Gotcha on this, act d...

Re: Additional Supporting Documents for EEA Family permit !!

I can't help I'm afraid, but am in almost exactly the same position. Having read through other people's experiences, I realise I should have included a fair bit more detail and documents. My plan is to prepare the docs for a new application and assume the first one will be refused. If it helps, this...

Re: SS route France Brit/Chinese Family Permit Success stori

What is a "marriage license" ? I've never heard of that and it sounds like an American thing :? It's actually very 'British' A Common Licence replaces the need for banns if having a church wedding. Or a Special Licence if the couple don't have a connection with the church in which they want to marr...

You can get into head of caseworker (or IO scrutinising your docs at border) here: https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/309122/30748_-_Annex_16_Notice_02-2014_-_Surinder_Singh_-_redacted.pdf Yes, I've read through this a few times before, thanks. Re: SS route France Brit/Chinese Family Permit Success stori

Thank you chaps. We're actually thinking of moving/renting another apartment in France, longer term. I put on the cover letter that we wanted to come back to visit family and collect our remaining belongings, which is basically true. We haven't fully decided where we will be for the birth, it might ...

SS route France Brit/Chinese Family Permit Success stories?

Apologies for the catch-all title. Me:Brit, wife:Chinese History - Met 2011. I moved to China early 2013. She moved to Britain August 2013 on a student visa. April 2015 applied for marriage license. August 2015 married (both families attended, etc.). January 2016 wife's student visa expired so she l...
