Re: Passport application mistake - original birth certificate

Just to be clear, I also mailed my certificate of naturalisation According to https://www.gov.uk/apply-first-adult-passport/what-documents-you-need-to-apply, I thought I'd just need to submit the below: You have a certificate of naturalisation or registration You’ll need both: your naturalisation or...

Passport application mistake - original birth certificate

Hi I just attended my naturalisation ceremony today and went straight to post office to submit my current South African passport via the check and send service. I think it will be mailed tomorrow morning, I got an email already asking me to upload supporting documents as follows: Applicant’s documen...

Re: ILR to citizenship - long absence abroad in 2020-21 (pandemic)

I would correct the idea that if you apply with above 450 days absences it is under 'discretion', and if you are below then it is not. Naturalisation is always by discretion and unlike other applications, eg ILR, even if you meet all of the requirements you may not be granted it. This is why the gui...

Re: Practical question about submission + absences of 839 days

Hi, Between 4th June 2014 to 29th September 2017, I was out the UK 459 days, across 22 trips ranging from 3 days out to 78 days out. During this time I was on a Tier 4 student visa and then Graduate Entrepreneur Visa and never had a break in my permission to be in the UK and applied for these visas ...

Re: Practical question about submission + absences of 839 days

Hi The definition of 'residence' here is confusing. I have been in the UK on and off since 2011 when I came on a student visa to do my undergraduate degree. I have been on various visas since and probably continuously (ie I did not leave the UK to apply for a visa) since around 2014. I plan to attac...

Practical question about submission + absences of 839 days

Hello, I have a premium appointment booked for Thursday to submit my naturalisation application, after 3 year ILR route (exceptional talent) + 1 year free of restrictions. I have decided not to use the IDV app , though was said I am eligible, due to concerns about delays/issues with the app. I have ...

Re: Over 740 days absence, less than 900 days

Craw19 - thanks for the feedback. Was your assignment related to military/civil work? They seem to make special allowances/reference to that in the guidance. For me, my work realated travel is less 'government sanctioned/supported. Did you provide proof at all of properties etc? One immigration lawy...

Re: Over 740 days absence, less than 900 days

The section "Absences during the qualifying period ", ie the text that starts "Where the applicant has absences of between 480-900 for applications under section 6(1) of the British Nationality Act 1981, or 300-540 for applications under section 6(2) and otherwise meets the requirements you must onl...

Re: Over 740 days absence, less than 900 days

Hi,

I have read those sections but struggle to understand what they mean in my case and what I'd need to prove? I have been on and off in the UK for the last 10 years but have considered it my main base for for the last 8.

However as of today I have spent 739 days out the UK in the 5 years before 1st October 2022. I need to travel out the UK for work between now and 1st October 2022 and know I c...

Re: Getting 3 years ILR on Exceptional Talent

Okay, so if I work back from June 2022 my qualifying period will only start June 2019. That is after the Jan 2018 'transitionary period'. So is my time away calculated in blocks still, or rolling 12 months?

Re: Getting 3 years ILR on Exceptional Talent

Hi, Thanks for this The problem is, I just crunched the numbers and I'm way over: - In the 12 month period June 17 to June 18, I spent approximately 284 days out the UK - In the next 12 month period June 18 to June 19, I spent approximately 285 days out the UK I'm now back in London to decide what m...

Getting 3 years ILR on Exceptional Talent

Hi guys, I am from South Africa and running a startup between the UK and South Africa. Our business model relies on us employing a lot of people in South Africa. As such, I need to travel back to South Africa a lot but I have read the rules and been advised that I can't really get an exemption for t...
