Re: PR for Extended Family Member

Thank you both. Actually, I just checked the policy and all members of the household are covered in the CSI starting from April 2011 till end of March 2015. RC was granted on May 2011. I guess we will need to extend the Policy for another year and apply in April 2016. Do you know how is dependency n...

Re: PR for Extended Family Member

Thanks Jambo, What about if we apply for my wife's PR first and once we get it we apply for my sister on the basis of my wife's PR plus evidence that the EEA national did not leave the country for 2 years. I though that it was only required to show that the EEA was exercising the treaty right for 5 ...

Re: PR for Extended Family Member

Thanks Obie,

Could you point me where it says that the EFM needs a CSI for the period of 5 years to be successful in their PR as I'm not being able to find this.

What I don't understand is why would you need a CSI if you are fully working and paying a high contribution via tax.

Thanks in advance

Re: PR for Extended Family Member

Hello Obie, I'm confused because I'm the income provider in the household and I'm not restricted to any regulation hence my income will count as the household income. My wife is exercising the treaty right as self-sufficient hence the need of CSI and income (my income). Concerning the EFM, do they s...

She has been living with me (PR holder more than 5 years) and my wife (Belgium) for the last five years hence part of the household. Initially she was de...

fysicus, I would challenge your response merely because of my own experience. you can certainly sponsor a dependent once you acquire PR and exercising the treaty rights. Think of people who are divorced or gained the PR after retaining the right of residence. I would welcome any evidence that says o...

Yes, he can as long as he is still exercising the treaty right and his mother is financially dependent on him or she was part of his household before he moved to the UK

read the guideline for OFM applications

The receipts being on his name is fine

I hope this helps

Be aware that you will need to prove that your wife is exercising the treaty right for full 3 years and you would need to submit this proof which means that cooperation from your wife is necessary.

Hi Amarula, Starting the divorce wouldn't be a problem as you could get it following the legal path and any Citizen advise bureau should be able to help explain this. The problem you are having is that you will need to prove that you husband is a EU member and exercising the treaty right in the UK. ...

According to the Caseworkers guidelines:

to qualify as exercising the treaty right: you should either be self sufficient and have a comprehensive medical insurance or be working.

Applying on the merit of your husband working does not qualify you.

I hope this helps

Thank you Directive/2004/38/EC. I honestly put a lot of careful thinking and mostly followed the guidelines and previous appeal examples. I tried to fulfill all the 4 steps: 1- financial dependency in my country of origin for parents and sister (before coming to the UK). Evidence through affidavits ...

Hi abulotus, I wish you luck with your applications. Just make sure you read the guidelines for OFM. I would like to note that I am a British Citizen, obtained on the basis of 1 year after obtaining my PR (check my other posts). I was entitled to keep my old nationality hence I used the EEA path bec...

Hi DFDS, Thanks for the reply I found the stages which, in my opinion, are OK except for stage number 3: Would refusing the application deter the relevant EEA national from exercising his/her free movement rights? . This is really debatable and I can only wonder how would the the casework qualify em...

Hi Vibe, I am afraid Yes. you should provide financial evidence so the Home Office is fully satisfied. living with someone under the same roof or teh same address does not mean being dependent. Please note that this is not an automatic right and is at the discretion of the UKBA. I would suggest fulf...

I wouldn't risk it and I would suggest to ask your wife to wait for another year before applying for BC. I don't understand what's the rush for her because PR will give her the same right as BC except fro voting!
