You as the British spouse is the one that has to be exercising treaty rights. Your non EU spouse activities are irrelevant. Your non EU spouse is dependent on you being a qualified person exercising treaty rights for their right to reside in Spain. They cannot sponsor you. I am not asking my spouse...

So does anyone know if this might affect anything in my rights to stay in Spain?

Is it allowed that the non-eu spouse is the worker, providing our means to support ourselves, and the EU citizen is dependent for tax and healthcare purposes?

Proving right to work for non-EU spouse?

My non-EU spouse's potential company (in Spain) is asking her to prove that she is able to work here, but she doesn't have any papers to do so. But understandably, her company are hesitant to hire her without feeling secure that she is indeed allowed to work.

What can she give them to prove this?

Yeah I did consider it, especially when I heard that we would have to wait 10 years in Italy to get a passport, but we decided we want to move now and not wait several more years :/

I think so. Your wife can use her residence card under article 10 of the Freedom of Movement Directive as long as you travel together.
