Re: Newborn and border crossing without pre settlement status

See this article on the case of a UK-born baby given a tourist entry stamp (with no right to work.. you know in case she tried to get employment!). Note that in this case the parents had ILR. If the mother had permanent residence or ILR (by no means clear that she did), then the baby should have be...

Re: EU Settled Status to Citizenship for Non EU family member

But believe it or not, home office advisor said he can not rely on spouse visa either because I got my settled status as an EU family member. I personally do not think the advisor is correct. As a person with settled status (ILR) I should be able to sponsor my husband for spouse visa. When I challe...

Re: Is CSI required for Non-EEA family member and EEA national applying for citizenship with settled status

Can I just ask if they require evidence of lawful residence for 5 years before being given settled status so 6 years in total such as 2014-2019 +1 ILR or 5 years back from the date of the naturalisation application e.g. 2015-2020 But for the question of good character, it's just the 5 years before ...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

For example, withholding relevant information or using deception in immigration applications over the last 10y period will lead to refusal. So, even if the applicant meets the 3 or 5 year "lawful residence" requirement as per BNA 1981 they may be refused because of, say, deception in their dealings...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

When EEA citizens are not excercising treaty rights and not lawfully in the UK, I have always wondered where that leaves the employer of their non-EEA citizen family members? The employer won't know that the non-EEA citizen's RC is now invalid/that they are not in the UK lawfully, unless that emplo...

If you're exercising 'treaty rights' (e.g. working), then legally yes, but most new employers will insist on seeing evidence of pre-settled status (or an imminent residence card had he appl...

Re: Flying to the UK after having been Registered as a British Citizen

I assume you may use the visa to get on a plane to the UK but at the border you will be admitted as a British citizen if you are British. Is such admission acknowledged policy? Yes. As long as you arrive at the UK border, you will face no problems getting in as a British citizen as you cannot be de...

What reason do you have to believe that that would be granted if the intention is to live together in the UK after marriage?

All seems correct. The family permit is only essential if your family member would need a visa to visit the UK.

Would an Irish passport and birth certificate (as well as his birthplace in Dublin being recorded on the marriage certificate) be sufficient evidence of non-Britishness? He has also registered with the EU Settlement Scheme as well just to be safe so we have an approval number for that. Having pre-s...

I fear that your civil partnership might not be recognised in the UK. At the stroke of midnight of December 2nd 2019, PACS became legally considered a civil partnership in England and Wales. See this post . I'm glad to see the Immigration Boards collective mind kicking in. One of the strengths here...

Re: Married to an Irish person in UK as an American - When is EU Settlement Scheme application possible?

If you are from the US you typically do not need a visa application to visit the UK, so I was wondering if it is also possible to present my marriage certificate and my spouse's EU Settlement Scheme info upon entering to the same effect as this family permit, while travel to the UK is still general...

I helped in 17 cases all were in the same situation but under EU Settlement Scheme they were accepted. What was the problem with getting an RC, PRC or DCPR in these cases? If they were refused because the EEA sponsor's status as a 'qualified person' was not accepted, then they means nothing in this...

Re: PLEASE HELP ! my eu family permit rejected.

With having marriage certificate you can 100% apply for eu settlement scheme. A marriage of convenience is not good enough for the EUSS. The HO appears to have already decided that Blackjack123's marriage is a marriage of convenience. You are assuming that the records for the administration of the ...

Re: PLEASE HELP ! my eu family permit rejected.

However, I think the results of this interview would be used to refuse pre-settled status. I believe you need to get the EEA RC sorted out first - except that you should apply under the EUSS by 30 June 2021.
