Re: MN1 section 3(1) application refused

Hi Ali,

I didnot use any covering letter as such. I did mention the facts on the prescribed form (NR) and asserted that the decision was not in line with the issued guidance (citing the relevant parts of the guidance).

cheers,
alladin.

Re: MN1 section 3(1) application refused

No. You pay and they keep the reconsideration fee iregards of the success. In your case, since you made the correct valid application within the validity of your child's visa, and the ILR was subsequently granted, the reconsideration request became a moot point. No need to even process it, so they ...

Re: MN1 section 3(1) application refused

I got a refund of the reconsideration fee for the reconsideration request I made on Feb (the history of my case is described above). Does anyone know if this happens if the reconsideration is successful?

Re: MN1 section 3(1) application refused

Best of luck on your application. In my case, I applied for ILR on the day my daughter's visa was expiring and was granted ILR (both on 3rd Sept.). And today I got her certificate of registration as British citizen although I didn't make an application for that. I did have a pending MN1 reconsiderat...

Re: Born-abroad child w/o ILR - MN1 3(1) refused

It might be beneficial if you post your own topic, reason for refusal etc, rather than just tag on in a sticky thread. Thanks. My case is discussed in this topic itself (please see previous posts). Basically I applied for my daughters naturalisation under Section 3 (1) as myself being BC and my wif...

Re: Born-abroad child w/o ILR - MN1 3(1) refused

Does anyone know timeline for reconsideration as I am waiting for the result? As I understand, they dont have a timeline but is it correct? There is no timeline or set timeframe for HO to process reconsiderations. They will take as long as they deem necessary. Thanks for your reply. If I want to ch...

Re: MN1 section 3(1) application refused

Thanks for replying. She has been in the UK for 1.5 years now. She came to the UK when she was 1.5 years old. She is 2 years and 11 months now. What is the child's current visa status? I am of the opinion that you will struggle to get a favourable response with a reconsideration request. The rules ...

Re: MN1 section 3(1) application refused

You can ask for a reconsideration. There is no rule that this is not allowed for refused citizenship applications. The decision was correct, a child born abroad is expected to hold ILR (settled status) to qualify for registration as BC under section 3(1) Thanks CR001, Do you know if there is any ti...

Re: MN1 section 3(1) application refused

Section 55 Borders, Citizenship and Immigration Act 2009 Imposes a statutory obligation for the decision maker to consider the best interest of the children in such cases. Where one parent is settled and the other is British it appears contrary to section 55 not to allow such an application, despit...

Re: I just got British Passport. Travel to India Advice...

I think you should be ok if you use Indian Passport for entering and leaving india. If it is after 3 months of your naturalization, indian embassy can fine you around £140 for each trip when you surrender indian passport. But as previously suggested, you could surrender your passport and then apply ...

Re: MN1 section 3(1) application refused

Alladin Well watt u think based on the reasons he refused whereas circumstances and chapter 9 statements are tellinga different side of the story. I think since your wife is not settled yet, there may not be a strong case to use discretion to register the child. If your wife is eligible for ILR, ma...

Re: MN1 section 3(1) application refused

There was this post http://www.immigrationboards.com/britis ... 0251.html# which referred to some recent judgments in related cases.

But wouldn't you think CW may have acted as per the guidance? I am not an expert, just asking.

Re: Applying for naturalisation for my child

As I understand it, the status of children born outside the UK is in-line with that of the less-privileged parent. I might be wrong, but I believe that both parents need to be British citizens before applying for registration under Section 3(1). According to the guidance "Children born abroad to pa...

Re: Naturalised but travelling on Indian Passport

Thanks Alladin. So, are you saying I shouldn't fill in the landing card but show my Indian passport on arrival in the UK and explain my naturalisation situation to the officer here? Or should I just proceed with a Landing card and Indian Passport and not mention the naturalisation at all? Thanks ag...

Re: Naturalised but travelling on Indian Passport

IIRC, you would not need to fill in the landing card when returning to UK as it is only intended for non-UK persons. Since you are naturalized, UKBA will let you in when you arrive. I think since you no longer is an indian citizen, other embassies would need your valid UK passport for any visas etc.
