Thank you for that. My partner and I have been together for a number of years but are not married. The regulations for naturalisation only seem to apply to spouse or civil partner?

Thanks for all advice and support. Indefinite Leave to Remain received today. We applied on 16 July which was twleve days late and the ILR stamp is dated 26 July. I did as advised and wrote to the Border Agency apologising for our error and it seems that they accepted our apology. Well done Border A...

Thank you for that oldno7. I am beginning to get the feeling that my problem is somewhat more serious. My partners Visa was issued on 4 July 2008 and we came to UK 19 days later on 23 July 2008. Barclays bank would not give us a bank statement so we delayed the application whilst trying to get it th...

I now have more information from my partners employer. They tell me that her two year qualifying period starts from the day the original visa was issued (4 July 2008) and as this has passed she is no longer eligible to work in the UK. The Immigration Regulations clearly say that the two year period ...

ILR problems with employer

Having apparently overcome the hurdle in my post earlier in the week we have now come up against another problem with my partners application for I.L.R. Her application has been submitted to the Border Agency but her employer now tells her that she is suspended from work without pay until her applic...

Thank you for that info Casa. We were careful to keep all evidence during the two years that we have been here. We have more than is asked for but are submitting it all.

I will come back to the board and give the outcome of the application as soon as we get it.

Thanks to all.

Thank you for your reply sushdmehta. I have now been told by someone who has been through the same thing that the Border Agency will accept the printout as long as it is certified by the bank. I just hope and pray that this information is correct. Unfortunately the banks can do pretty much what they...

Last minute lifeline wanted

My partners Unmarried Partners (Settlement) Visa expires on 23 July (ten days away). She passed the Life in the UK test and filled out the application form at the beginning of this month. All supporting documents are complete and in order with the exception of her Barclays Bank statement which was a...

Working Tax credit and ILR

This is my second question on ILR. My partner has NRPF. Working Tax Credits are classed as Public Funds. In response to an enquiry to the Tax Office we were awarded Working Tax Credit against my partner’s income. We wrote to Revenue & Customs telling them my partner had NRPF and we therefore could...

ILR and ESOL

My partner has to apply for ILR and needs to study ESOL at the local college in order to apply. The college tell her that because her Entry Visa says Unmarried Partner instead of Spouse she has to pay £800.00 for the two four month courses. If we were married (for one year)the courses would be free...

Hi nchowdhury and ribena, The British Embassies overseas seem to serve no useful purpose whatsoever and that is the cause of my original problem. We sought the advice of the British Embassy four months before submitting the application and got absolutely no response whatsoever. We complained to the ...

Sorry to hear about your problems nchowdhury. Unless you are a British citizen acting as a sponsor, or representative at Appeal, the British Embassies overseas are accountable to nobody. They can unreasonably refuse visas and there is nothing you can do. Even if you win your appeal they know that by...

I’m sorry I did not respond to hello_kitty. You were lucky to get the visa in 7 months. Bear in mind that, in theory, it is possible for the Embassy to prevent you from ever getting a visa even though your appeal to AIT is successful. If they think that you will be successful on appeal they are ab...

Many thanks for your sensible and level headed response PP. I don’t know if I will be able to get a Judicial Enquiry but I will certainly try my best. I am not railing at the system; I know the system is not perfect, but I have ample evidence that, even prior to the submission of the application, ...

Thanks for your comments and support. Whether or not the appeal is successful I shall be seeking a Judicial Review on the original decision to refuse the visa. I have definite grounds on which to do this. Correct procedures were not followed and the ECO failed to consider the application in the ligh...

Thank you so much for your reply Sarah. It is so good to know that you are not alone in these things and it is good to have some support. You are very lucky to have all the support that you have – I envy you. I have done some research on the Appeal and found that if you send it to London it is sen...

Refusal causing hardship

Can somebody please help us with some advice. My partners Unmarried Partner Visa application has just been refused and we are desperate. The grounds for the refusal are completely wrong and many of our supporting documents have been completely ignored. We have been living together in the Philippines...

More advice on Unmarried Partner Visa please

Thank you for your response Victoria, it is most helpful and I can follow that up. No I don’t have any savings. This question always reminds me that there is one law for the rich and another for the poor. If I had money I would not be I the position that I am in at the moment, I would just pay for...

Some observations

I would just like to offer some advice to people applying for Visas that I have gained by personal exp erience. If you are applying through a British Embassy or Mission overseas, these can sometimes be very unhelpful and unfriendly if you are in need of advice or assistance - particularly if, like m...

More advice on Unmarrie d Partner Visa please

Hello everyone, I am new here and I am here because it looks a good place to get some advice. I will try and keep it short and to the point. I am a British widower living in the Philippines for the last two years with my unmarried partner. (proof available)’ I have been caught out by the British g...
