ILR When to apply

Dear all,

I want to apply for ILR in person but need to know exactly when it will be suitable to apply:

WP was stamped on my passport in 15 Nov 2000 (in country application), however I started working on 02 Jan 2001.
Can I apply on 19 Oct 2004 or do I have to wait until December to apply ?

The application was made while I was in the UK, therefore the stamp means "when the Home Office stamped the visa on my passport".

Why would I not qualify for ILR based on 10 year stay ?
