Re: Tier 2 PBS Dependent Visa Extension

Hi CR001 - I have a query to check with you. As now my family is in the country (entered UK on 24th June, 2020), Is it OK for them to apply for ILR without any risk to their application outcome? Little Background ## Their 5 year leave was granted with the valid from date 19/06/2015 and valid until 1...

Re: Tier 2 PBS Dependent Visa Extension

Thanks for your responses. Appreciate that. Couple of queries out of those. ## What makes their ILR case little tricky - they were not in the country for last 22 months(approx 2 years) and were out of country at the time when I applied for ILR. They will be in country by end of this week. I understa...

Re: Tier 2 PBS Dependent Visa Extension

When was their first dependent visa issued? ## It was issued in 2015. There are 12 months in a year. When exactly were the dependent visas issued?? Why do they not qualify for ILR yet if their visas were issued in 2015 at some point? ## As mentioned I have already applied for ILR on 2nd June, 2020 ...

Re: Tier 2 PBS Dependent Visa Extension

When was their first dependent visa issued? ## It was issued in 2015. PBS dependents get a 3 year extension if you applied for or have ilr. This is clearly stated in the immigration rules. ## As mentioned I have already applied for ILR on 2nd June, 2020 and awaiting bio-metric slot and decision. See...

Re: Dependents ILR Eligibility

if I get the ILR - yes - they are expected to be on family visa route but what if they apply at the time when my ILR application outcome is yet to come? Can they apply for PBS Dependent VISA during that grey period (from the time I apply my ILR till I get the outcome -- considering only standard ser...

Re: Dependents ILR Eligibility

You are right. There are no border restrictions in UK but there are in India as airspace is closed for commercial flights. When you say they should apply PBS dependant visa before my visa expiry does that means me applying for ILR has no bearing on that? My understanding was that if I apply for ILR ...

Re: Dependents ILR Eligibility

All in the family has the same visa expiry date - 18th July, 2020 and we all had the 5 years visa starting in 2015.
I am planning to apply for my ILR on 22 May, 2020 to get the process started. Family is still in India as they couldn't able to travel before border restrictions.

Re: Dependents ILR Eligibility

Thanks experts for all your help so far. I have a 2 queries(after reading the responses on other threads). Re: Dependents ILR Eligibility

Hi Zimba – Thanks once again for your response but this time I am little confused. When you say “assuming they have completed their qualifying period too” what do we mean by that? I am assuming you mean completing 5 years from Visa issue date (as absences don’t affect dependents where visa issue dat...

Re: Dependents ILR Eligibility

Thanks Zimba for coming back on this. Appreciate that. So from what I have understood - Dependents are also eligible to apply for ILR at the same time as of main applicant and their absence won't affect as PBS dependant visa was issued before 11th Jan, 2018. Is that correct? And if yes, then what ab...
