Re: Travelling Pending Appeal

The absences exceeded by 70 days. Or so which is what I'm appealing. I think they should have applied discretion. HO obviously chose not to apply discretion in your case, which by the way is VERY rare in long residence ILR cases. If you are over 540 in the 10 years, it is a refusal, regardless of y...

Re: Travelling Pending Appeal

Was it refused due to exceeding the absence limit?? Or something to do with your EU sponsor? https://www.immigrationboards.com/eea-route-applications/eea-family-member-rules-t265208.html#p1689259 What were your absences and in particular the one long work related absence you wanted discretion on? Travelling Pending Appeal

Hi team My application for ILR (10 year route) was refused a couple of months ago and I appealed the decision. My case was due to be heard in court a week ago, and I made plans to go on a short holiday 2 weeks after. However the case was postponed to another 6 weeks. I still have leave valid for 2 y...

Re: EEA Family Member rules

Is the reason the home office returns the documents for EEA applications within 10 days due to a protection in EU regulations? It's not so much a protection as that EU laws are significantly different from UK laws. The UK Immigration Rules state that if you withdraw the passport, the application is...

Re: EEA Family Member rules

For ILR under the UK immigration rules, you can apply in person for a same day decision. If you leave the UK while your application is pending, then your application will be considered withdrawn. What applies to EEA/EU rules, does not necessarily apply to applications under the UK Immigration rules...

EEA Family Member rules

Good evening team I am wondering if there is any EEA regulation that prevents the home office from keeping hold of an EEA family member's passport (and therefore restricting their movement) for 6 months? I am thinking of applying for ILR under UK immigration law. But it seems the process is quite di...

Re: Will the Settled Status route allow combining non-EEA visa residence to meet 5-year requirement?

Wishful thinking? What do you think? So looks like it is indeed wishful thinking unfortunately. Persons eligible for indefinite leave to remain as a relevant EU citizen or their family member EU11. The applicant meets the eligibility requirements for indefinite leave to remain as a relevant EU citi...

Re: Long Residence (10 years) SET (LR) applications

Is there a halfway house between the same day decision when applying for ILR premium service and the 6 month waiting time for the postal application??

What are the waiting times generally for the postal applications? I can't seem to find a thread for timelines for ILR LR

Re: Will the Settled Status route allow combining non-EEA visa residence to meet 5-year requirement?

She also mentioned this IS also currently the case with the PR system. Example - if you are a Canadian citizen on a Tier 2 visa who has lived here for 5 years, but married to a Danish citizen who has lived and worked here for 5 years, then the Canadian citizen can apply for PR. It is not a requirem...

I was about to post the exact same question on the forum. What do the mods think? I don't want to end up duplicating questions here.

It will affect whether I chose ILR-LR which is 2500 pounds or the 65 settled status application.

Ireland and UK issued EU FM RC

Hello

Just wondering if anyone had experience of going to Ireland using a UK issued EU-FM RC.

My partner won't be there. But I'll be travelling for a friend's wedding alone. Do I need to apply for a separate visa?

Thanks

Signed for post

Hey peeps For those who received a FM-RC does the home office send it in a "signed for" envelope? I'm only asking because I received one today while I was out of the flat. I'm going away for a couple of weeks and it's been returned to the post office. If there's a chance it might be the RC I can cha...

I was able to re-enter the UK using my tier 2 BRP. No concerns/questions about my outstanding RC application.

Not necessarily ... The letter that accompanied it specifically says that whoever employs me needs to check with the home office within 6 months (max) on the final decision of the RC.

Just to clarify I am still waiting for an official reply regarding the RC application and whether it's been accepted. But at least I have my passport.

Re: Tier 2 General to EEA Residence Card

Yes you still need to submit your biometrics. Not sure why. there is a thread with a timeline for this you can find my post in there. For me I submitted the application around the 22nd of Feb and I had my CoA letter and passport and BRP back with me by the 13th of March. It seemed to be a bit quick ...

Re: Travel while awaiting decision re RC

Just to update you all. So I went on the trip to Europe this weekend and used my Tier 2 to gain entry back into the UK. No questions asked. As long as you receive both your passport and visa when you request your documents, it should be ok to travel it seems. Just make sure you let the home office k...

Hello guys Thank you for all the help you've provided so far. I asked for my documents to be returned (while awaiting application for EEA(FM) RC application) and specifically mentioned that I need my documents for travel. Theyve sent both my passport and my Tier 2 card which is still valid. Do you t...

Requesting passport and documents back

For those who have experience with applying.

When and how can I request my documents back for an EEA FM RC (UK based application).

I can't find the information online.

Cheers
