Re: FLR(FP) Application time

Hi folks, Can someone help, please? I'm helping a friend with her FLR FP 5 year parent route application. She is a single parent and sole carer for her two British kids was given 2.5 years on that route in 2018. It is due for renewal in January 2021. Does she need to provide details of her ex (child...

Does Zambrano (derivative) now count towards 10 years long residence ILR

Hi folks, can someone please tell me if time spent under Zambrano visa can be counted as part of 'lawful' residence for 10 years indefinite leave to remain, please? My partner was on the Zambrano track but switched to the 5 years parent route under the immigration rules instead since the Home Office...

Re: Has Zambrano ruined my partner's chances of making 10 years legal residency ILR application?

Hi there, I will be grateful for any information relating to my partner's situation, please? Basically, I'm trying to find out whether she can apply for ILR via the 10 year long residency route if she's been on a Zambrano visa for a year in between. She came to stay in the UK on 26th May 2006 on a ...

Re: Has Zambrano ruined my partner's chances of making 10 years legal residency ILR application?

Hi guys, I am rekindling this thread instead of starting a new one following the government's publication of the EU settlement scheme rules. From the new regulations, https://www.gov.uk/guidance/immigration-rules/immigration-rules-appendix-eu it seems that those who are exclusively on the Zambrano r...

Re: Has Zambrano ruined my partner's chances of making 10 years legal residency ILR application?

Sure. In the meantime, I came upon this blog, which suggests that 'derived' residence can still be counted towards the 10 year long residence ILR: https://www.freemovement.org.uk/can-time-spent-under-eu-law-count-towards-a-10-year-residence-application/ What do you make of it? But she is not a fami...

Re: Has Zambrano ruined my partner's chances of making 10 years legal residency ILR application?

"Permanent residence A person with a derivative right of residence cannot acquire permanent residence in the UK under the 2016 regulations. This is in line with regulation 15(2) of the 2016 regulations. The Court of Justice of the European Union (CJEU) also considered in the case of Alarape (C-529/...

Re: Has Zambrano ruined my partner's chances of making 10 years legal residency ILR application?

The rules suggest that the period during which I was awaiting a response for the visa application and the appeal isn't illegal Applications under the EU regulations are not covered by Section 3C or 3D of the UK Immigration Rules, so any time waiting for an EU route derivative residence card applica...

Re: Has Zambrano ruined my partner's chances of making 10 years legal residency ILR application?

Thank you so much. Yes, the Zambrano is indeed a derivative residence visa so the point you raise would be valid. However, guidance for the 10 year route also states that apploicants should have been in the UK legally for 10 years (known as your ‘continuous residence’) so I wonder if the period on t...

Dependant on Tier 2 visa

Hi folks, I will be very grateful for advice on a friends behalf please? He's not very computer savvy so he can't post here himself. He is on a tier 2 visa with his wife as dependant. Their visas expire in about 3 weeks time, but having found out about a string of affairs by his wife in the last he'...

Re: Updates on Zambrano applications

As I say, everyone who is refused must appeal because the adds are that the court will overturn the decision. Once they start realising that their senseless refusals will not be allowed to stand by Courts, they will stop that silly behaviour. Congrats

Re: Updates on Zambrano applications

This is probably no comfort to you, I guess, but the thing is that they are literally drowning in backlog of applications and the six-month turnaround policy is simply fictitious as many on here will tell you, from their own experiences. My friend's took almost two years from the date of first appli...

Re: Updates on Zambrano applications

An addition to the importance of appealing Zambrano refusals. A friend was refused last year after nearly a year of waiting for a decision. Her original solicitor advised her to forget everything and try Article 8 instead. However, reading from Wigsy (who has been of incredible help!) and others on ...

ILR Granted

Hi folks, I'm pleased to say I have finally received approval for ILR. I got the letter on Monday and the card came a day afterwards. Thank you all for your support and advise. Its because the UKBA is such an unpredictable body to deal with, and also because the prospect of potentially having to resort to the courts to resolve this matter, with the attendant costs, delays and anxieties, was too much to bear. Its such a huge relief and I think since I found that they've tak...

The UKBA has now taken my payment!! I sent them new card details three weeks ago when I found out the original payment had failed. However, as they neither took the money nor got back to me, I presumed it had not worked. Imagine my surprise then when upon checking my account this morning, I found th...

Working

Just an an update, I still haven't received my paperwork from the UKBA so the wait goes on. I was wondering however; where do I stand in terms of work, please? is any employment I take illegal because of my circumstances or because I can still apply, I am able to work legally. Thanks for your assist...

Thanks, this is very informative but I'm just wondering if there is any way of compelling the UKBA to send me the documents before the 28 day grace period so that I don't even have to go down the route of a judicial review or some other protracted legal tussle. All of this is really very frustrating...
