If the immigration comes to your marriage they won't let this marriage happen because they will arrest you and deport you being an overstayer....then you have to marry her in ur own country and applied from there but they need solid prove that the relationship is genuine and she is execering treaty ...

U are married for three years, u will get right of residence but u need her Id and pr document..and divorce as welll..ask her for pr document and id

If your eea national partner arrived in 2007 and continuously working till 2013 then she is already be eligible to get the confirmation of its PR status as long as wrs (worker registration scheme) criteria has been met (if A8 national).
