Thanks CR001 but I am not 100% clear on my sons situation. Are you saying that he can not apply for BC until one of the parents applies for (or is granted BC). Also - I have a son born abroad in 2013.
He has no history of overstaying in the UK.
Will he be able to apply for BC as soon as I am granted ILR?

Our situation was different to yours.
In the end we used the AR process to get a successful result.

I suggest you just ring your local MPs office and discuss it on the phone with their staff. That is what I did and it became very clear during the call that MPs get a lot of calls from people with immigration issues. You are correct. I checked my wifes BRP and it is as you stated.
I learn something every time I visit this forum.
However, they seem to be inconsistent as one of my children has no work restrictions while the other has a restriction on work as a sportsperson.
