I recently moved out after my husband stated he wants us to move to another country. Hardly sounds like a reason to leave your husband to me. You have already left one country to be with him? Shouldn't you be more worried about your marriage than your ILR? The facts have been answered to you by oth...

Short trips don't seem to be a problem at all. During my wifes 2 year visa she went back to her home country about eight times and we went on a 5 week holiday to other countries. She also went on a few business trips. In total she was out the UK for about 80 days during the 2 years. We fully documen...

I can't blame you from trying to apply outside the rules or dream that there may be a loophole. We were exactly the same for 7 years. From reading this forum and other related information on the web it soon became very clear there weren't any and an in country application would be futile even though...

Here are my none professional thoughts from someone has been here for a while and had first hand exprience of a spouse who was an overstayer. 1, If you are married you can apply for a spouse visa, if not it is either a fiance visa or any other visa that leads to settlement in the UK if you qualify. ...

Remember to take a pen so she can fill out a landing card whilst you both go through the non EU queue. Both go up together and just hand both passports and say you are X's husband, That is what we do, ofen it is quicker than the EU queue.

I think a few 'overtsayers' do not take the seriousness of their breaking the law seriosuly enough. All too often we hear from those who feel it is not their fault they overstayed their visa and that their case is somehow more important than others. We have seen a few cases lately where overstayers ...

Only thing I can think is to take letters addressed to either of you spread evenly to cover the whole 24 month, including the first 10 months. When we applied in person they were more interested in making sure the docs were evenly spread rather than them being addressed to both of us. They particula...

Update. Wife now has ILR. Not the most pleasant experience going to Croydon to get it but was all done in 3 hours so better than waiting by post. Generally most people were friendly once past the security guards! Only 1/3rd of the letters were in both our names but it was never questioned, although ...

A lot of mortgage companies will not lend to those who have a time limited visa. There are companies who will do it but expect to pay higher interest. Natiowide wouldn't take my wifes salary into account when I wanted to increase the mortgage. Ironically we didn't need her salary in the end but out ...

I would suggest that is a good sign. It is certainly better than a rejection without an interview. An interview is completely normal and is to ensure application is geniuine. Just ensure your wife answers all questions honestly and that they correspond with what is written in the application. I trus...

I would be to go through all the reasons you were given for the rejection and look at ways you can demonstrate they are wrong. Any attitude that they are wrong and you are right will not get you very far. The first point is they are not happy the sponsor was at the wedding. If you don't have more ph...

My wife will be applying soon too for SET(M). It is surprisingly difficult to get official letters in joint names. Certainly I was not possible to put my wifes names on utility bills as they refused to do it! I didn't think of the Council tax bill as our house is in my name. We have a bank account i...

Overstaying on its own is not a reason for denying a settlement visa application, but most certainly will have a bearing on the application as it casts doubt on the intentions of the applicant. The use of the word 'also' in the rejection letter infers this is exactly what has happened here. As John ...

But I reckon it very much depends on luck.
That is why the advice is always to provide as much evidence as you can, even for apparently straight forward cases.

With the money it cost these days and the delays that can occur if an application fails you can do alot to ensure 'luck' is on your side.

I wish you all the best. If you do intend making an out of country application make sure it is not outside any of the rules. I suspect you will find out very soon? From personal experience we decided an in country application was a waste of time; a solicitor told us he would take it on, but it was going to be very costly. The new fees announcement has made me so annoyed it I want to hurt someone! My biggest 'gripe' is someone here on a work based visa does not pay so much for ILR as a spouse bu...
