Hi cloud0112, I read the dates wrong. Your case is similar to mine. Only thing that is not clear is if you had continous leave Please provide the dates on 1. when you got married and started your cohabitation in UK 2. when your PSW expired. 3. when you applied for dependant visa It matters whether y...

I feel that the refusal is incorrect. In my case, http://www.immigrationboards.com/viewtopic.php?t=129265&highlight= the appeal against a similar decision was upheld by the first tier tribunal. The only difference in this case is that the OP has entered UK after grant of the visa on 24th July 2012(a...

My wife was in a similar situation. Her ILR application was refused and then the appeal was allowed. I had a very frustrating experience with solicitors. I would summarise my experience as - most solicitors I spoke to were bad(I am trying hard to be positive here)...It is better to follow what peopl...

The appeal was allowed. Thanks a lot everyone for the support. I will update the post with the case reference numbers when I get the determination in writing. The hearing was today. The hearing was quite straightforward. At the start, the presenting officer said that the UKBA was withdrawing the dec...

Thanks a lot for the help. Finally submitted an appeal yesterday via the company solicitors. They have submitted IAFT-1 only. No evidence or supporting documents. They said they will be doing that closer to the appeal date. I have in the mean-time passed on the Statement of intent, rules in place be...

Her company solicitor has turned round and said there is ground for appeal. So I do not have much option. If I go by them, I have followed their advice and her job should stay(no legal requirement) even if she has to go back to India. http://www.garthcoates.com/ I am not certain of his competance. I...

I have been going round asking people to read the rule and interpret it without me specifying my case. So far, most people interpret it the way most of us do. The only thing is most solici...

Hi zulfiqar, It explicitly states that you must have been the partner of a person under any category of the rules before 9th July, 2012 must have lived together for 2 years. This is independent of the visa type. It does not state that you must have "been granted leave as" partner of a person under t...

But even solicitors I talk to are not sure. each one has a different opinion. I guess I will appeal any...
