Re: Partner Visa granted instead of Parent Visa

can this be bookmarked for future reference so others don't fall in the same loophole? The search engine on this site isn't the best at times.

Re: Partner Visa granted instead of Parent Visa

How it has been explained to me is as follows: Partner takes higher prevalence over Parent. If Partner is not satisfied then child can be used as an exceptional circumstance to support a partner instead of being reviewed in its own right. Because I mentioned a girlfriend in the section of 'what hard...

Re: Partner Visa granted instead of Parent Visa

Stumbled on this in a section that talks about exceptional circumstances which further makes the burden of proof on my part even harder: Second, if an applicant does not otherwise meet the relevant requirements of those Immigration Rules, you must move on to consider, for a family, under paragraph G...

Re: Partner Visa granted instead of Parent Visa

If you have not been living together, then how did they conclude E-LTRP.1.10. The applicant and their partner must intend to live together permanently in the UK and, in any application for further leave to remain as a partner (except where the applicant is in the UK as a fiancé(e) or proposed civil...

Re: Partner Visa granted instead of Parent Visa

She is British and I mentioned that I am seeing someone which the caseworker then termed as a relationship and as such she is my partner. He then asked for her passport and stuff. I have been reading the GEN and it is vague enough to be used either way. I don't see why a relationship with a woman wi...

Re: Partner Visa granted instead of Parent Visa

Thank you all for your input. Thats what I get for being honest, such a shame. Its like they try to encourage people to play the system instead of embracing honesty. I think I am going to donthe administrative review, I am only hesitant because I hope it has no negative ramifications. Might consider...

Re: Partner Visa granted instead of Parent Visa

I cannot see how they may consider a girlfriend, who is not living together with you, as a partner under Appendix FM. In what different meaning of partner elsewhere in this Appendix does she satisfy GEN.1.2.? I am quite confused myself. I read the full guidance and at best it is open to interpretat...

Re: Partner Visa granted instead of Parent Visa

Morning, This is what I got back: " You applied for Leave to Remain on the Parent route, however as you have a Partner you have the be considered primarily on the Partner route. The Gov.uk website and published Guidance confirms the following: The parent route is not for couples who are in a genuine...

Re: Partner Visa granted instead of Parent Visa

I did not apply as a partner or spouse, i applied as a parent so my concern is why i was assessed first as a partner and not a parent. In hindsight maybe i shouldn't have mentioned having a relationship but being honest and open now seems to have done me more wrong than good. This is a renewal of my...

Re: Partner Visa granted instead of Parent Visa

Hello Korekt, Thank you for your anticipated help. A. This is what I was asked for previously when my application was still being reviewed: 2. You state on the form you do not have a partner but that you have recently started seeing someone. This constitutes a relationship. As such we need you to co...

Partner Visa granted instead of Parent Visa

Hello All, Trust you are all doing well during these trying times. I applied to extend my leave to remain as a parent in June 2020 and last week received a decision granting me my visa. Though I am glad that my visa application was successful and that I can continue being a dad to my daughter, the v...

Access to Child Visa within UK

Following on from my previous post in 2017, it is time to renew my Leave. As we are in new climes with most posts on her about partner and marriage applications, and I thought i would be good to open a discussion. @Moderators if there is already another topic on for this i do apologise as I couldn't...

Re: Access To UK Child

Hello Nim,

I had a letter and sworn affidavit from my child's mom and that didn't work so I would strongly recommend getting the court order to save you some grief. The court order process took 7 weeks for me, from start to finish.

Re: Parent Visa (father of a British Child)

I agree with wise. i would also encoutaged uoi to get a child arrangement order as I have seen that used before to refuse the visa even when the child's mother had written a letter to the home office in support. Chold strangnebt order is fairly easy to get, fill out c100 form, pay 215 GBP, and the w...
