HELP NEEDED DESPERATELY

Hi My husband's original visa was refused under 320 11 (overstayer) and 281 (ECO didn't believe our relationship was genuine). We appealed and won in June 2010. My husband received his call letter and handed his passport in July 5th. He has rang the BHC Delhi to ask when he will get his passport and...

I was not advising anyone...if you read my post clearly I did say 'as far as I know' - this is because I have read on other topics and other forums that this is the situation. When you use the terms 'as far as I know' it clearly does not mean that I am advising - in fact it states that I am unsure. ...

Hi Happi As far as I know it shouldn't make a difference as your application is decided on the documents submitted at the time - so technically you don't need to inform them of your change in job. However if it was me then I would send a letter and fax to BHC stating that you have a new job with an ...

I thought that with that ruling it meant that you could argue 3rd party support in appeal if you were originally refused visa. In relation to a new /fresh application 3rd party is not allowed as it is not permissable in any immigration laws or guidelines for ECO's to follow. is that right or wrong??

I'm not an advisor but it's not going to be as easy as they say to get back into the UK. The fact that you have overstayed will be an issue - even though it technically shouldnt be. Your partner will have to satisfy the accommodation and finance requirement and if she doesn't then it will be a big s...

My husband only became aware that he was an overstayer in May 2009 and he was detained and removed in July 2009. We did put a lengthy explanation for his overstay and they still refused the visa. They only refused under 320 (11) and because he couldnt be trusted they also said our relationship was n...

My husband was refused spouse visa as he was an overstayer. I would say that your best solution is to appeal and fight the 320 (11) refusal. I dont see the point in a fresh new application. You need to submit the appeal within the 28 days - dont waste any more money on a new application.

My husbands visa has just been declined this week. Im not too sure of the next steps and have a legal advisor helping us now. From my understanding you can appeal and the case will get reviewed by ECM. If they overturn the original refusal then you wont have to go through the whole appeal process. S...

Just to let you know that my husband was an overstayer - no deception or anythng like that. We applied for a spouse visa and it has been refused. They refused under 320 (11). And due to him being an overstayer they said that his credibility was an issue and they dont think we have a real relationshi...

rule 320 11 is used at the discretion of the ECO. There are no set guidelines on which situations it is applicable on. I personally think that the rule would be considered in the OP's situation. ECO's use this rule to refuse visa's very regularly. Op needs to get professional advice from a decent im...

If you apply as a spouse you are exempt from rule 320 7b. However the ECO can apply rule 320 11 at his discretion. If deception is used then this is most likely to be used. If you are refused you can appeal though. Every case is different and you need to be truthful in any application you submit. Yo...

You definately need a wear a suit whether advised or not. Even if the other staff or interviewer are in casual clothes they still like to see that you have made an effort and are presentable. wear a shirt and tie as well. make sure everything is ironed and clean...the one thing people always forget ...
