I thought that with that ruling it meant that you could argue 3rd party support in appeal if you were originally refused visa. In relation to a new /fresh application 3rd party is not allowed as it is not permissable in any immigration laws or guidelines for ECO's to follow. is that right or wrong??

My husband was refused spouse visa as he was an overstayer. I would say that your best solution is to appeal and fight the 320 (11) refusal. I dont see the point in a fresh new application. You need to submit the appeal within the 28 days - dont waste any more money on a new application.

No you dont...you would have to leave your own job to move to the uk so it makes no difference if you are working or not..

rule 320 11 is used at the discretion of the ECO. There are no set guidelines on which situations it is applicable on. I personally think that the rule would be considered in the OP's situation. If you apply as a spouse you are exempt from rule 320 7b. However the ECO can apply rule 320 11 at his discretion. If deception is used then this is most likely to be used. You definately need a wear a suit whether advised or not. Even if the other staff or interviewer are in casual clothes they still like to see that you have made an effort and are presentable. wear a shirt and tie as well. make sure everything is ironed and clean...the one thing people always forget ...

as far as i know the halifax can accept a letter from the following confirming your address - register with a doctor an then get them to write a letter confirming where you love. religious minister can also write a letter confirming your address as well. the halifax really use these as a last resort...

spectral88 You have to make the decision with your girlfriend on whether you saty and wait for the decision of the COA or go back to your home country and apply from there.
