CCJ on file, any impact on ILR application.

With few defaults and a very recent ccj, how it impacts the ILR application based on tier 1 general?
Thank you

Re: Overstay of 28 days allowed?

If your brother's visa expires and if he applies for another visa within 28 days and if he is successful in that, the 28 day overstay is ignored for future immigration applications. Note that immigration law is separate from naturalisation law and it is possible that the overstay may have an impact...

Overstay of 28 days allowed?

My brother's visa is expiring soon, he is planning to go back but he had to sort out too many things before leave to wind up his business etc. Someone said that overstay of 28 days is allowed. He may have an overstay of 28 days or little more, will this affect his immigration history or when he is c...

Re: Can HO cancel Driving Licence and Bank accounts?

The banks and police can verify the process of AR or JR in case they want to We don't need to prove it. I think you are assuming way too much integration. Data in government departments is most likely kept in silos, which is not accessible even within departments. Which would be why the same docume...

Re: Can HO cancel Driving Licence and Bank accounts?

As regards bank accounts, see Section 45 and Schedule 7 of the Immigration Act 2016. But they have not been commenced yet. And while it seems the driving licence of somebody in the UK whose leave has expired is not cancelled, it can be seized and retained by the police. It would also be a criminal ...

Can HO cancel Driving Licence and Bank accounts?

I have heard that now HO is cancelling driving licence and closing bank accounts whose visas have been refused or have expired. Personally I don't believe this as driving licence and bank accounts are personal things, they can be used abroad as well, UK licence is valid in many countries and it's is...

Re: Salary not sent to Bank, how to Prove?

Was the cash banked? No, that's the issue. If you banked the cash you would have a corresponding bank statement to match with payslip/s in approximately the same time period. It would help corroborate that the payslip was 'genuine' or that it, at least, represented a certain sum of money that came ...

Re: Switch from Self Employed to Company

Assuming you are on Tier 1 G if you are self employed, ALL Tier 1 G applications are thoroughly checked and HO check back on your full history as Tier 1 G and income/taxes. Yes I agree and am aware of it, my record with HMRC is up to date, just thought being a ltd company it might be a smooth proce...

Re: Salary not sent to Bank, how to Prove?

Hi guys, I have a small issue if someone can answer. My first 3 months salary was not sent to bank for some reason, I If you do not get from HMRC then you could at least print month by month salary from HMRC online (last option if you do not get any other alternative). However, seniors might be abl...

Switch from Self Employed to Company

Hi friends, Will it be a good idea to switch from self employed to Company just 2-3 months before ILR application? Will it affect my status in application for ILR? The earnings being as a self employed for the early period will still be considered as self employed? Common perception is that self emp...

Salary not sent to Bank, how to Prove?

Hi guys, I have a small issue if someone can answer. My first 3 months salary was not sent to bank for some reason, I got them in cash, I received regular payslips for them. Re: Tier 1 general ILR application after tax ammendment

So they are very much aware and do consider the earning claim considering this issue as for most applicant tax year and UKVI claim will not be same. what they looking for is, whatever you claimed is declared on that year. Not necessarily the tax year also it should be over the threshold.[/quote] Rep...

Re: Tier 1 general ILR application after tax ammendment

There are 6 months (sep 2013-april 2014) remaining until end of tax year April 2014 and there could potentially be £4000 worth of expenses. If you had self-employment expenses, you had expenses. Simple. The latter six months would fall into OP's subsequent tax year. So any expenses in that period s...

Re: Tier 1 general ILR application after tax ammendment

How come the £4k 'expenses' were not accrued for in the accounts at first? That amount of additional unexpected expenses suddenly appearing and not accrued for is somewhat incredulous. Alright, 2-300 quid maybe, but not £4k. I'm sure what UKVI are thinking is inflate income for extension, then 'fin...

Re: Tier 1 general ILR application after tax ammendment

@shah23 I understand your case and HO caseworker will also add two tax year figures to see if your claimed earnings of £35,000 for 12 months match or not. As its obvious that accumulated claimed earnings on HMRC for two tax years should at least be £35,000. As per your question on second half of ea...

Re: Tier 1 general ILR application after tax ammendment

Based on your answer underlined here, what I gather is that you wouldn't have been awarded the points for the 35K threshold after the amendment. Because your actual earnings for that period after amendment would be £15K + £16K = £31K, which is in effect lower than the £35K points threshold. Therefor...

Re: Tier 1 general ILR application after tax ammendment

Is it objectionable by HO as the profit in the second half of the second tax year fell down with more expenses affecting the profit figure of the first half year (already declared to HO), although at the time of application all the figures were fulfilling the HO requirements ? Reading through this,...

Tier 1 general ILR application after tax ammendment

Hi, Does anyone has got a complicated case like this in terms of earnings and tax? My tax return figures in HMRC and HO will not match even if I do any tax amendments, the reason is because my 12 months earnings (declared to HO in my previous application for extension of Tier 1) were covering 2 tax ...
