1. I sent them all for 3 years of marriage (they normally ask for 1 year proof)

Hi Bobobo I would call & ask them a new letter saying that you have retained your rights independently of your eea spouse. Mine, which was sent to me with my new RC, clearly states that. Last time I passed through immigration control in Gatwick I had to present this letter to avoid further questions...

I think that their decision should be based on the rules which a set for them by Directive. When I retained my rights, I had to provide the docs that my ex was exercising her treaty rights before the divorce as it’s says in the Directive about it. Not sure what do you need to provide for the 1st year when you didn't work. They might ask you to provide Comp. Insurance. I applied with EEA2 as I haven't completed my 5 yrs after marrige yet.

Why do I need insurance? We were both employed during our marrige,and had rights to use NHS services for free. I'm planning to send them my 5 years P60 + payslips covering 5 years from the date of marrige.
