sorry for crashing into this thread, but i have a similar quesiton... what is rule if current visa expires 4 days BEFORE completion of 5 years.... but it is still well within 28days .. for ex- my current visa would expire on 16 apr 15 and i will complete 5 years on 20th apr 15 can i apply 28 days b...

You can apply on the 31/03/2016 as you get a 28 day relaxation

My wife got the visa. The case worker got confused with the colored photocopy of the degree...so once we sent the covering letter to check the docs again...he must have found it and granted the visa. Thanks. Just for future reference for anyone reading this, when making photocopies of the documents...

It was a medical certificate from India and not an NHS one. When I applied for my ILR this rule was just introduced and people were very confused(proof of absence rule)..from my understanding they are not really worried until the absence is not more than 180 days in one year.

I had 177 days absence in my first year of Tier 1 visa. I submitted medical certificate for 177 days. I was not even working at that time. If you entered UK within three months of your visa stamp date then you just add 4 year 11 months and 2 days to the visa stamp date.

Else you add 4 year 11 months and 2 days to the date of entry in the uk.

Send a letter. It's more likely to reach the person. ok we are sending a letter in courier to say that we have already sent the original degree and there might be some confusion related to it as the colored photocopy looks alike.
