I cannot comment on the matters related to divorce etc. But as far as the visa is concerned once anyone obtains ILR then they become completely independent to the main applicant. It doesn't matter through what route he got ILR. You cannot get his ILR revoked on the basis of break in relationship.

Technically its all the same. My wife was qualifying on both 3 and 5 years basis. In the end we applied under 3 year basis because I thought that would make a stronger case ..... that was just my perception, there is no reasoning behind it. I believe ILR is generally required for children born outside of UK because his citizenship application will be under section 3(1) which is a discretion and not an entitlement. Seniors might be able to tell you better.
It would have been a lot simpler to have included him in your ILR application.

Tricky question .... ILR ceases once you are naturalised so if you complete naturalisation process then you cannot go back to the same ILR. You will have to go through the whole route again to gain ILR again. But I think there might be one solution. Technically, adults are not considered naturalised...

Don't waste your money on a solicitor, since there is no hard and fast rule he will not give you anything of value. It should not be a problem. The council should also send you a confirmation letter for your appointment, you should be able to use this one. Best call the council and ask them.
