Mishandled case by the consultant !

Dear All,

I am new member of this forum.

I applied from Pakistan through a consultant, referred by my two friends who get approval in Sep'2003 through the same consultant.

I submitted the documents to consultant on Dec 30, 2003

My Claimed point's were

Education - 15 (MCS from University of Karachi, Pakistan)

Salary -

Experinece - 50 (I have been working as IT Head
since, 1997)

On May 20, 2004, I was informed by the consultant to submit the
experince certificate from present employer, which i submitted in
a week time.

I was hoping a positive reply but unfortunately I was informed last week
that, my application was rejected and i secured only (15 (EDU) + 25 (EXP)
points.

Can any one guide me what to do in this sistuation ?

Can i file the case against decision and how ?

Also, what i need to provide for getting my claim apporved for Manager level 5+ years experince and salary (what documents needed ?)

Specially, the person who filed the same claim from pakistan can guide me
about the documents.

in what way he mishandled the case ? Also if you can tell us what all documents you had provided to prove your seniority ? How many years of exp. do you have in all ? From your mail nothing is clear. For getting 25 pts this is the criteria :
5 years work experience in a "graduate level" job - you don't have to have been a graduate at the time, but the job must be one that would usually require a graduate - 25 points

for getting 50 points you have to show 5 years of senior level or specialist level experience. If you are a IT head then you got to show senior level exp. i.e in your experience letter , how many people you are managing has to be shown.

you got the right to appeal. You can do it through the consultant/yourself. I hope your consultant is on a no-win no fee basis

Well, I do have a 13+ years post grduation experience

and working as IT Head since, last 6+ years

Also, i provided the documents regarding my salary which

is in band 1 of Group D i-e > UKP 7500

If they gave u 25 points of exp and 15 of education then it will be 40 and if u fall in Income band 1 i.e 7500 GBP then they should also give u 25 of earning and hence it will be a total of 65 and u should qualify.
Why don,t they give u earning points ? Did u provide full evidences for past earnings ?
Plz write in detail ur claimed points.

That's the tragedy

I thought, my claimed points as 15 (edu) + 50 (exp) + 25 (income) = 90

and provided the documents asked by the consultant

but i thought, he didnt prepared the case in a right manner that's why i said it's a mishandled case

Your past eaning at 5 years graduate level experience showing your experience level. Thats why they gave you 25 points in your experience catagory regardless of your current position.

Dear smmalick

I suggest you to please share the rejection letter you recieved from Home office. Ask your consultant to provide that to you. That will help you understand that in which section what you scored and if not then HO normally give an appropriate reason for no points entitlements.

If you really have MCS + 10 yrs exp and also scoring in earning category. you must get HSMP. This is for such persons.

Share me the letter, I hope me and other will certainly help you figuring out what went wrong for you.

I will surely share the letter as soon as i will get the same from my
consultant.

Hopefully, i will visit them on coming saturday
