MN1 after ILR

Post by MubaZaara » Thu Dec 02, 2021 9:02 am

Hi ,

I am holing British passport (Naturalization on 2020) and my daughter born in india refused citizenship due to no ILR for my wife.
This year i have applied ILR for my wife and daughter and got the ILR.

My question is : Shall i apply MN1 straight away ? Since my daughter holding ILR do i need wait for 12 month ?
12 month after ILR rules apply for MN1 ?

Thanks

Children born abroad do not need to to wait for one year after ILR before applying for registration as a British citizen, but they do need to have one parent being or applying to become a British citizen and the child themselves and the other parent to hold ILR.

Your child can apply immediately after ILR for British citizenship, as both the child and mother have ILR.

I am not surprised. It is an expectation for registration of a child born abroad that at leats one parent has or is applying for British citizenship and the child and other parent hold ILR. You rushed in without reading the requirements and expectations and got a very predictable result.

Now that the expectations are met, you should not have an issue.
