MN1 or ILR for UK born kid

Hi,

Tier-2 general visa granted in 14 Feb 2009
leave to remain 14th Feb 2014.

My kid born in July 2009, she got Tier-2 dependent visa.
I am going to apply ILR by 20th Jan, 2014 (28 days before ) at PEO

Can I apply my kid MN1 after me granted ILR.
Is there will be any issue ?

The child is entitled to register as British by virtue of section 1(3) on form MN1 as soon as a parent has ILR.

How to calculate 28 days.
As my visa expire on 14-02-2014, Can I apply earliest 18 Jan or 17 Jan ?

First Entry Clearance: 16-Feb-2009
Entry to UK:- 13-Mar-2009
Leave to Remain: 14-Feb-2014
In last 5 years out of UK:- 75 days

Please let me know when I can apply it at PEO latest.

From 28 days before 16-Feb-2014 so from:
Sunday, January 19, 2014 (Practically, that will be Monday 20th Jan 2014)
