Naturalisation application - proof of living in the UK for 5 years

Post by Justo » Thu Oct 01, 2020 10:46 pm

Following five years of Tier 2 General and one year of ILR, we are now applying for naturalisation.

I wanted to clarify what do we need to provide as a support for "Proof of living in the UK for [NAME] for 5 years if applying in your own right or 3 years if applying as the spouse of a British Citizen"

I am planning to provide the same documents I submitted for ILR last year: scanned passport with all pages, as well as accompanying letter where I list out all my travels (I travelled extensively, so did not have enough fields in the form).

Would the above be sufficient?

Also, I suppose no travel history is needed for our son? (it not on the documents checklist)

This is not an immigration application! All you need is your passport(s) covering the qualifying period i.e. 5years or 3years (if married to a BC) and relevant passport stamps. Nothing else.

This is exactly what I am planning to provide. Thank you

You only need to list the absences for the last 5 years (assuming your applying in your own right) and make sure you fulfil the residence requirements.

When applying for ILR last year I was fine from absences standpoint. Assuming I did not travel much recently I should be fine now? .. just checking that citizenship requirements are not stricter then ILR..

Did you read the AN guidance before planning to apply?

Also, good character guidance:

No, but now I did and I would appreciate if somebody can provide more clarity on:

Code: Select all

• You must have been physically present in England, Wales, Scotland, Northern
Ireland, the Isle of Man or the Channel Islands on the day 5 years before the
application is received by the Home Office.
• For example, if your application is received on 05/01/2022 you should have
been physically present in the UK on 06/01/2017.
I am living in the UK since May 2014.
My naturalisation online form was submitted and paid 28 September 2020
My UKVAC appointment is on 28 October 2020

Reading the above requirement, do I need to check and be able to prove that I was physically present in the UK on 28/10/2015 or 28/11/2015?

Are you applying in your own right? Better clarify that. I am assuming you are applying in your own right.

If you paid and submitted your application on 28th September 2020, you must have been physically present in UK on 29th September 2015. Your visa stamps will prove that. But if you were not in UK on 29th Sep 2015, you have a problem then.

Also between your 5 year qualifying period counting backwards from 28/9/20, you should not be outside UK for more than 450 days and not outside UK for more than 90 days in the last 1 year.

Luckily I was in the UK on that day. (Not as if anybody cares, but I find this rule wired).

I am also good with 90 and 450 days rule.
